| Looking for a good personal injury lawyer
Pretty serious matter, and kind of a dumb place to be asking, but thought maybe some members have had some experience and have some suggestions.
Basically was working at my job and fell off a 3 story apartment (wasn't wearing fall gear). I fractured my femur and hip and injured a bunch of other things. I had surgery and was in the hospital for 11 days and I have been out since friday.
I am going to receiving wage loss pay every 2 weeks thru WCB. I was wondering if I should seek a personal injury lawyer though because of my injuries and the fact that the company I was working for had no safety gear at all and never preached anything about it.
The doctors said I am lucky I am not paralized with any spine damage and I also do not have any brain damage. I am very lucky to be alive considering some ppl have died or become paralized falling from just 10 feet. I fell 30 ft.
I am now confined to my apartment. I have crutches, a walker, a wheelchair and a hospital bed in my living room. A nurse comes to my house 2 times a day. My social life is 0 and I am going to be recovering for roughly 6 months. I am taking pain killers and blood thinners (had a blood clot). WCB pays for my meds and nurse care etc.
WCB sent me a cheque for $364. I don't know what this cheque is, but it was based on the length of time I was working for the company (not long I was only there for 2 weeks) and a couple other factors.
I have been told to pursue legal action against the company I was working for, and that is why I wanted to seek a personal injury lawyer to just get some advice. I was wondering if any of you guys knew a good lawyer or have had any experience with a situation similar to mine.

Also Slater Vecchio.
Probably one of the best injury lawyers in vancouver, but be warned they charge an arm and a leg, and will charge for any fees they incur (like photocopying, background searches etc...)
If your injury is worth $$$ i'd give them a call.
Seriously give them a call. Your injuries are severe.
For a simple icbc claim they got 40k from ICBC, but you havce to follow their orders.

For a simple icbc claim they got 40k from ICBC, but you havce to follow their orders. | I don't have a lot of cash to give up front. I was hoping I could connect with an injury lawyer who say the settlement was 20k, they would take a % off of that total and you get what is left (say 14k).
Do you know if I have to pay for all the fees up front? I guess I can just call. I found their website.

They took a cut from the ICBC claim.
Good luck.
Many rs'ers have had good experiences with Slater Vecchio, and a few friends of mine which are ICBC adjusters hate dealing with them.

you fell over 30ft? holy shit!
you're one lucky bastard to not have sustained more serious injuries.
Recovery is going to be tough, BUT PLEASE STICK WITH IT!!! I've seen so many people not keep up with their rehab and their time to recovery is abysmal.

Wish you the best man. | Yea just over 30 feet.. yea physio is really painful but gotta stick with it. A physio person comes to my place every couple of days to do exercises with me.

If anything, WCB should be investigating your employer to see if they were negligent in any way that could have contributed to your injuries.
If your job requires you to work with heights, i cannot see any employer not providing harnesses and safety gear. If you were negligent in wearing such equipment what are you expecting a judge to do ? Give you $ for your own negligence ?
I see long term disability if anything...

I am relatively new to this type of working environment. I was told not to stand near the edge on my first day. But this company does not use fall protection. I have never seen an employee wear any type of safety gear at all. I have never even heard an employee talk about it. I feel like I should have asked about it now that this has happened. At first I felt really bad about what happened. But at the same time from my understanding, it's the employers responsibility to look after its employees in any type of unsafe environment.
I am pretty sure wcb is going to be giving my employer a fine. From my understanding, wcb investigated the site where the accident happened, they shut it down for a couple days and now the company is using fall gear when working at that site.

I see long term disability if anything... | I agree, My company's policy is that they will suspend employment on the first offence of ANY safety infraction, and terminate on the 2nd. That policy is probably why they won the VRCA contractor safety award for something like 9 years straight
It's usually site policy and not up to his company to decide if fall arrest is required. But there are some shady companies out there that just don't follow the rules, and they should be sued into oblivion.

Hopefully you signed a contract when you were hired and you read the fine print.
I've worked at 20+ ft before setting up pallet racking with no harnesses, yet was always holding onto something. Not the smartest thing to do but I did it.
Yet with this company, your first 3 months your on probation so you have to kind of prove you want the job, so if anything happened they would give me the boot. Injury being one of those things. In the fine print the contract did even mention that if injured I would not be given compensation by said company, and I would be laid off because of my own "personal negligence." Hopefully this isn't your case.
I've also worked for companies where you get hired through an agency, work for said agency, and in your contract, your considered "self-employed." So if you get injured, the company won't pay you out and WCB won't deal with the company, only you. Again hopefully this isn't your case.
Anyway, don't mean to get you down, wish you the best of luck and hope the 2 above situations aren't what your in.
