WITNESS NEEDED PLS!

HI!
got into an accident yesterday around 3pm at the intersection of Grandview HWY / 12th Ave & Nanaimo St.
I was heading eastbound on 12th and the guy was turning left onto Nanaimo.
Light turned yellow as I got into the intersection and he decided to turn.
2 car collision, both are civics, Black & Silver.
If anyone was there and saw it, pls let me know!!

OP, If you're asking for help, then you need to provide as much information as you can, because people are going to have questions. What kind of accident? What direction were you headed? What models of cars were involved?

keep fighting it, icbc likes the 50/50 because icbc gets the most money out of it, if your accident was near a gas station you could ask to view the tape, i had a friend do that and it actually worked well

Thanks for the advice, this is my first accident so I'm learning as I go.

I'm just afraid that if he lies and says that I ran a red so I looked up the redlight cameras but there isn't one at that intersection.

if he turned into you icbc usually finds him at fault as you had the right of way, even if it is a late yellow, just keep fighting it

The problem is that I hit him, as soon as I saw him start to turn I slammed on the brakes... :QQ:
I don't want to settle for 50/50. I know I didn't do anything wrong and because the damn guy just started yelling at me when I was asking if his ELDERLY passenger was ok...

still his fault, icbc states that someone should not make a turn unless it is safe to do so, so unless you ran a solid red you should be in the clear

75/25 probably... U might get lucky cause as a left turner e is only allowed to turn when it's safe.... In this case it wasn't... And they gonna tell u that u were traveling to fast to come to a safe stop before proceeding to run a yellow

unless the conditions were poor, she was within the speed limit and he turned cuz he assumed he could make it, ive had a few friends in accidents similar and in every case the person turning was at fault 100%
once you tell icbc something you have to stick with it, they start seeing fluctuation in your story, your credibility will be shot, so if you already havnt spoken to them you need to tell them that you were not speeding (if you wernt) that you were unable to stop safely (if you wernt) and it was not safe for him to enter the intersection assuming he could make it (if thats the case)

Since this is my first accident, I'm quite nervous.
I'd like to put faith in the system, but a few ppl I've talked to about this say that ICBC might decide that it's 50/50.
Another thing is, I'm afraid that he might lie and say that I ran a red. That's why I'd like to find a witness to cover my bases.
If he says that then HE needs to find a witness or proof that you ran a red.

He cant just say something like that, he needs to prove it.
However if he does have a witness then you might be in a bit of trouble.

He shouldn't have a witness, unless he's getting someone to lie for him...
he admitted that it was a yellow light when he turned, though he was adamant that he was still right...

A witness may make or break you in this situation. I was in an accident identical to this, in your position. It seemed like I was in the clear to get 0%, then a witnesses finally called back after 3 weeks, said I ran a solid red and I was deemed 100%. I'm the most granny driver out there, would never run a red, let alone a late yellow. Even though my brother was in the car and saw the lights turning, couldn't be an independent witness.
Not trying to scare you or anything, just saying :P

well yellow light is your go, thats why the yellow light is there, for you to safely make it through the intersection

well if he "THINKS" hes right and tells ICBC the same story (turning left on a yellow), ICBC will state to him that he is infact wrong, and that he is at 100% fault.
The thing you want to hope for now is that he doesn't spend more of your time to go to court, etc...

And they didn't question this "anonymous witness" ? what if he just got his friend to call and make up that lie?
argh... that's what I'm most afraid of.. The fact that he would go off on me when he's wrong, makes me think he'd run out and find a fake witness....

how much are you willing to pay for a witness :troll: jk
dont worry about that, if it happens raise ur concerned to icbc, they do have a fraud division and will look into it, as goes for now, he still thinks hes in the right, so let him think that and hope he says things that trap him in his own words

I hope you weren't so wishy washy when making your statements to ICBC... have some self-confidence and tell them the truth, don't doubt yourself... light turned yellow, car turned in front of you, you tried to brake because of that but couldn't... you had the right of way... it's the other driver's job to clear the intersection before turning no matter what. I know people who have been the other driver and swear that the light was red but ICBC still said too bad to them, left turner has to ensure the intersection is clear... the only way out for the other driver is with a witness/dashcam.

The witness saw the accident and gave us his info on site at the time of the accident. He just didn't bother returning any calls till 3 weeks after, which means his memory of the incident could've been a little hazey.
Hope it doesn't end like this for you, and you should claim any injuries if you are a bit hurt. A bruised knee or something might not seem bad at first, but it can get infected, shit like that lol.

Not totalled, my front bumper fell off... But I was able to turn a bit n so most of the damage is on 1 side. Its not broke or anything. I think I have less damage then your car.

called ICBC today, supposedly the other side has a witness. Which they havent been able to reach yet... I know there was a pedestrian but she left before I was able to talk to her.
She's an older lady that was already giving me judgemental looks when I pulled over. I just hope she tells the truth that the light was YELLOW when it happened instead of looking after it happened and saying it was red. People tend to think they know what they saw when theyre prejudiced...
ughh... will post signs up this weekend... :tears:

that really sucks that no one stopped and gave you info as a witness, ive seen a few accidents and always stopped and gave the driver that was in the right my contact info so they dont get bent over, good karma so hopefully i get the same luck in the future.
trust me, this isnt the end of the world, life will go on.
