please let me know your thoughts on this.

purchased a used car from a dealership, they said no accidents, showed me some paper from icbc stating none.
transfer form ticks no on accidents, their purchase agreement also says the same.

selling it half a year later, checked with carfax just to show buyers cars clean, it showed car was from the east and had at least 2 accidents, with 2 estimates totally over $4800 cumulatively ($2100 and $2600) but no "claims"

is this a breach of contract and can i sue the dealership for not disclosing this to me?
let me know your thoughts and advice.

Same thing happened to my friend. He trusted the dealership when they told them "no accidents".

I would go confront the dealer first. If there is no response, go complain to the association of car dealers. It took a while, but he got his money back.

i did but they said that because its not a claim and just 2 estimates that legally they are allowed to say it hasn't been in accidents.
so they said they would be happy to go to court.

i work in a car dealership myself. From my understanding the dealer have to declare the car have accident over 2000. As the statement said was the automobile have any previous accident and not previous claim.

im a car salesman.

during licensing we learned that if the dealership did not disclose a accident such as yours, first contact them and see if they can do anything. if they are unwilling, contact vsa(vancouver sales authority) for a complaint. vsa will step in and help.

in sales term, what they committed is a deceptive act.

vsa can make the dealership pay you or buy the car back. its not worth loosing their dealership license over.

this is a grey area.

but usually you cant go after the dealership after you sold the car.

at the same time its very hard or next to impossible for your buyer to get the money out of you for compensation. but you could always do it out of guilt :)

if the car was still yours, even 5 years after you buy the car, if you found accidents over 2k before you bought the car, you can lodge a complaint and will probably get money for it.

hey, give vsa a call on monday and ask. when i was part of the board volunteering, all we did was talk about cases and how to handle them.

they should able to better answer any of your questions.

hope it works out for you. because of vsa our car industry is alot better than before.

if i was to work for vsa i know alot of dealerships that would get closed. but its slowly happening now.

just look at kingsway. so many dealerships are closed because vsa stepped in and didnt alow deceptive acts by them. i remember there was a dealership on kingsway near a mall that had a lambo and looked to be selling alot of cars but closed down because of fraud.

good rule to follow, dont ever buy from lucky 8 no matter how good the deal is. vsa sooner or later will shut that dealership down.

Yeah always avoid kingsway or any of the smaller shady places, thought I was getting a good deal on a 06 tsx apparently clean history but turns out its was in a crash so bad it was basically 2 cars welded together

Many people are willing to go to those shady Kingsway dealers because they are attracted by the price. This is what happens when you are a cheap ass. Spend a bit more money and buy it from somewhere reputable and save yourself the grief.

Buyer beware. Do your own homework and carfax's.

Dealer disclosed ICBC (local) information, which was clean, but failed to disclose previous jurisdictions information (foreign)... which may or may-not of been searched by the dealer.

They may of knowingly sold a car with claims from another Provence but only disclosed BC information. Which is hard to prove.
