I went on the residential tenancy branch website but can't find a straight answer...

The toilet is is broken. It does not know when to stop filling and is wasting water with it going down the overflow tube.

Are repairs the responsibility of the tenant or landlord?

I'm moving out in about a week and don't want to cause any trouble. At the same time I don't want the landlord to keep my damage deposit if it should be mine to fix.

Right now the water valve is turned off whenever I go out to avoid possible flooding.

It's usually LL's responsibility.

I'd say it's landlord. They have to make repair for housing standards. i'd say a proper and running toilet is their responsibility. unless you damaged it on your own say in like a drunken stupor.

page 4 of the BC RTA:

10. REPAIRS
1) Landlord's obligations:
a) The landlord must provide and maintain the
residential property in a reasonable state of
decoration and repair, suitable for occupation
by a tenant. The landlord must comply with
health, safety and housing standards required
by law.
b) If the landlord is required to make a repair to
comply with the above obligations, the tenant
may discuss it with the landlord. If the landlord
refuses to make the repair, the tenant may seek a dispute resolution officer's order under
the Residential Tenancy Act for the completion
and costs of the repair.
2) Tenant's obligations:
a) The tenant must maintain reasonable health,
cleanliness and sanitary standards throughout
the rental unit and the other residential
property to which the tenant has access. The
tenant must take the necessary steps to repair
damage to the residential property caused by
the actions or neglect of the tenant or a person
permitted on the residential property by the
tenant. The tenant is not responsible for
reasonable wear and tear to the residential
property.
b) If the tenant does not comply with the above
obligations within a reasonable time, the
landlord may discuss the matter with the
tenant and may seek a monetary order
through dispute resolution under the
Residential Tenancy Act for the cost of rep

lower your float. the big black floaty thing that floats...generally on the left side :p

Easy fix for sure.
Its the responsibility of the LL to fix it if you are uncomfortable to do so or do not wish to do so.
Personally I would just take the top of the tank off and adjust it.....I hate the constant noise from toilets.......its like the ghost of the poo coming to get you!!!

I recently had this happen to me. It was the float valve and the kit from Rona cost somewhere between $20 - $30. Easy fix for sure.

We got the new toilet thing but don't feel comfortable messing around with it. I don't want to make it worse and have the landlord blame us.

Exactly how you described! It seems so cold that water drips onto the floor. That's why we turned off the water valve.

What are tank guts? You want a pic of the inside?

well your float is purple :p

shut the water off, flush, and stare at the float for a few minutes. its a very basic item, you should be able to find a way to adjust the level within 2-3 minutes. theres only so many spots where its capable of being altered, so play with it for a few minutes. i highly doubt you'll break the toilet from playing with the float while the waters turned off.

if i could, id do it for ya for a can of beer, but i cant :p
maybe someone on here doesn't live that far from you and would be willing to spend 5 minutes to go out of their way to help ya:)
