Some people say kit cars are illegal in Canada, which I know for sure it's false because I've seen so many kit cars driving around.

According to Transport Canada, kit cars must NOT be built by professionals. So I guess some dude has to be building one in his backyard.
Also the kit cars must NOT be imported built, it must be imported piece by piece, and built it in Canada, but not by professionals.

Why don't they allow professionals to build kit cars? Isn't it more safe?

Also I don't understand the difference between importing a already built kit car & importing car kit(parts) and build in Canada at somebody's backyard. Because in the end, you are getting the exact same car.

I'm not entirely sure why they have such strict rules about kit cars but from experience, I know you cannot bring in a kit car and try to register it. You also cannot bring in a kit car, disassemble it and then try to register it again.

yeah I tried Googling it and saw some Canadian kit car related forums.

Basically, you can NOT import a kit car and register it here.
But you CAN import a kit and build in Canada.
And the kit can NOT be built professionally, it must be amateur built by someone's backyard.

I believe it's based on a percentage built by the owner of said car, a company can build x percentage, but the new registered owner must have a certain build percentage of the car for it considered to be legit

My experience is only with Cobras but you can buy Superformance Cobras brand new from a Canadian dealership. In the case of my Cobra, it was brought in under the 15 year rule. In fact most of the replica Cobra owners I've talked to got their cars the same way.

I've checked with these guys before. They specialize only in the track version of the car, and that version is not street legal in Canada. They even include a line at the bottom of the page to say this:

The Ariel Atom is not legal for street use in Canada.

I just did a Google research and looks like Superformance is an automotive manufacture, not a kit car maker.
They build Shelby Cobras under official license by Carroll Shelby.

That I dunno. But from the superficial research that I've done, I think the manufacturer needs to play a major part in assuring the vehicles meet Canadian safety standards. TMI AutoTech is the licenced US manufacturer for the Ariel Atom, and I suspect they'd need to be willing play to make it happen.

I agree that passing street legality test in Canada shouldn't be too tough. The Factory Five 818 is street legal in Canada because F5 did the paperwork to ensure it so.

You can buy the car complete in Canada but not road legal. Because you can also buy them in the US and they are complete cars you can import one. You can do a u-build registration. There are a couple around Canada like this.

Reason why it must be home built and not by a pro is because when you have a professional build a car they become an auto manufacturer and it would require a whole different set of rules like crash testing and such.

I didn't know that Factory Five kits are Canadian safety standard compliant.
Not just 818, but looks like all their kits are accepted by Transport Canada. (I just checked their website)
