: Will my rates go up if ICBC finds me not at fault, but the guy sues and wins?

Long story short, couple years ago, pedestrian jaywalking in rain, at night, was hit by my vehicle, not at an intersection. ICBC found me not at fault, going about 50km/h, guy was conscious whole time, injuries didn't look too serious as I was braking as well when the impact happened.

Now he's still suing me/icbc so I have to go to a discovery, and it could go to court.

What happens if the court rules in his favor, or something like 50/50 at fault. I've been told its very unlikely, but I'm still pretty nervous and want to plan for the worst.

If he's suing you personally, it would be a civil matter I think. Which means your rates *shouldn't* go up. But it IS ICBC, so who knows...
