Is it against the law to ride a bicycle if you have a blood alcohol level above .08?

i would assume so on the road, since cyclist are expected to follow the same rules as drivers.

If you're drunk and on a bicycle (or just drunk out in public in general), you're arrestable under the Liquor Control and Licencing Act for being drunk in a public place.

Do you think that having your ability impaired so that you're not able to drive a motor vehicle properly means you're ability to ride a bicycle would be any better? It requires similar amount of motor skill, added in balance and less ease of maintaining a straight line.

Both Section 253 of the Criminal Code and Section 215 of the Motor Vehicle Act speak specifically to motor vehicles, which a bicycle is not.

i know that a cyclist can be issued a ticket for running a red light/stop sign.
I assumed some laws applied to them.

I'm not sure on the actual laws regarding this, but I believe that if bicycles are sharing the roadway with motor vehicles, they're expected to follow the same rules of the road/traffic laws. Those sections I mentioned above though, refer specifically to the alcohol/impaired related offenses.

im sure cops dont pull u over if u cycle when ur drunk. unless ur cycling naked

We've stopped a guy who was cycling while drunk before. Someone called it in because he was all over the road and sidewalk. He was only a block from his house when we found him, so we had him walk his bicycle to his house and called it a night.

Drunkenness in public place

41 (1) A person who is intoxicated must not be or remain in a public place.

(2) A peace officer may arrest, without a warrant, a person found intoxicated in a public place.

What about Friday and Saturday nights downtown when the bars close? Hundreds of people drunk out of their minds roaming the streets at 12-2am.

Is it just too much of a hassle for cops to deal with it?

biking while drunk seems like a good way to rearrange your face to me.

Even being drunk inside a bar is still technically a "public place" since anyone can enter whether the invitation is express or implied.

hahaha, dude you don't need to be intoxicated to rearrange your face on one of those. My buddy got himself 43 stitches on his face from face planting into gravel while he was riding a tricycle.
