Is it illegal to sell a device that is jailbroken? For example, apple tv, iphone 4, etc

No... Despite the name, jail breaking your phone is not illegal......
The only illegal thing is watching pirated shows or movies on Apple tv

While the process isn't illegal but downloading apps for free after the phone is jailborken is illegal because you are downloading something that should be paid for (ex downloading and using an illegal copy of Microsoft office or Microsoft windows).

ya i believe apple went to court to try to make jailbreaking illegal but that didn't fly. all it does is void your warranty if i'm not mistaken.

Its actually a guy who wants my ATV 2 but he wants it jailbroken which I can do pretty easily. He's just insistent on it being jailbroken before buying. I am just making sure I protect myself so I'm not doing something "illegal".

As long as you don't download anything illegal and then sell it I think you should be ok. Like others have said, the actual jailbreaking process isn't legal.
