Friend got into an accident. Questions

So the friend's car is turning left. Stopped in the middle of the island for a pedestrian that was jaywalking without a crosswalk. Car going straight didn't see friend's car due to low visibility and dark car, didn't slow down and T-boned friend's car.

Also, friend doesn't have roadstar. Does ICBC provide with a courtesy car or does friend need to rent a car in the mean time and will ICBC reimburse?

so your buddy was doing a standard left.... was it blinking green arrow ?? i cant see how he was jay walking unless it was a blinking green arrow turning left.

it is obviously your friends fault i think if he could of just turned left later.... waited for the car if the pedestrian was there or not.

Does he have the roadstar package, roadside plus package or loss of use?

If get doesn't have any of these and is deemed at fault, I'll doubt he'll get a free rental car.

Probably not a blinking green arrow if the car on the opposing lane was passing through (otherwise would be a red light for him/her).

To answer your first question, I believe it is standard practice to check and see if there are pedestrians or anything blocking your pathway before fully committing to take that left. Your friend should have checked, saw there was a pedestrian and waited.

On the other hand, the car on the opposing lane should have been driving to conditions and saw your friends vehicle at the intersection and slowed down.

I'm no expert but I think your friend is at fault. Situation could have been avoided if he waited. That is my opinion (always better safe than sorry).

unfortunately it's his fault, that's why you shoulder check unless it's a blinking green arrow in which case you also shoulder check. but let's say he did and the pedestrian showed no intentions of walking but darts out at the last minute, it'll still be your friends fault unless he has a dash cam or witness

I love how everyone has figured out fault here based on so little info.

What does "middle of the island" mean exactly? What direction was the other car going - oncoming traffic, or cross-traffic? The question of an advance green has not yet been answered. Where was the pedestrian anyway?

Diagrams, photos, maybe Google Earth shots of the intersection would certainly help...

No roadstar on his insurance.

There were no traffic lights. It was a cross traffic area.

^True but he had tons of time turning left but had to stop at the island because of the jaywalker. The red car was the first car going down and had tons of time to slow down or stop but did not. Anyways, he lawyered up.

The only possible way that I can see your friend not being 100% at fault is if he can proof that there was a long pause between when he stopped for the pedestrian and when the car hit them. Even then, it will most likely be 50/50

the thing i don't get is why is your friend's car's rear end sticking out to be hit? some islands are small so maybe he should have waited for the roads to be clear before he made a left turn instead of stopping at the island to wait.

the island were small so part of his rear end was sticking out. the roads were clear on both sides but the car that hit him was speeding down as he was the first car after a red light.
