icbc injury claim..
 
Okay.. so back in September i was in a car accident.. i was a passenger in the car, the cars tire popped on the highway which set off the air bags and knocked out the driver.. so we drove 100kmh across 3 lanes of traffic (it was around midnight) so there was no cars around thank god and crashed into the ditch and rolled for 100ft roughly 7.5 times, destroyed the car 5 of us in it but no deaths or seriously bad injuries.. I had really bad whip lash, 3 broken ribs and 2 fractured and hurt tendents and muscles in my neck and back. I was off work for about 30 days, and went to physio and massager person many times. Im 18 so i cant get the icbc claim till im 19, but not to be rude im just curious about how much i might get out of this.. (for future plans such as schooling payments) so if anyone has anything like my case if they could let me know. thanks alot.

Holy shit you're lucky to be okay and alive. but you did sustain a lot of injuries i'd say.

I think you should get a lawyer.

yah i know, i would but i really dont want the hassel of getting a lawyer and than lawyer fees and all that, i just want to get all this over and done with, i was just curious on how much i could get from all of it.

I don't see why you can't settle now. the money might end up in a trust fund untill you are 19. but you'd know the exact amount in the acount.

personly I think you deserve to be paid those 30 days of work, which you probably have been already, and your medical bills / therapy. you don't deserve anything else.

i allready got my 30 days off work payed, my medical and all that has been payed for also but well you might not think i deserve anything else, but people do get money after accidents.. so thats why i was asking.

Dude you really need a lawyer. In a case like this a lawyer worth his salt should be able to get you 75-100k . You only pay the lawer based on how much you receive...typically 33%. I strongly recomend not trying to settle with icbc yourself.

uh get a lawyer? its worth the fees and stuff...

they will be able to look at other cases and ball park how mcuh youd get after lawyer fees.

but yaaa...you may feel better now or you dont, either way...all your injuries will affect you the rest of your life.

the lawyer will ask and consider what kinda of career(s) you have/want, the physical ability and limitations that you have resulting and how they will affect the rest of your life...they will look at how much money you'll need to cover medical costs later in life, pain and suffering (including the fact that you may not be able to do things you were able to before like sports, even simple lifting, etc). bascially they can forecast how much money this accident will cost you over the rest of your life.

GET A LAWYER lol.

i got hit by reversing car in a parking lot and i ended up with a rotated disk in my back..this was going on 1.5 years ago and i have really bad back days where i cant sit or stand or move or sleep even now....and my settlement will be going on for another 6 months or so.

you wont see any money until at least 1.5 or 2 years after the fact anyways so you'l be old enough to have the money right away.

Good luck getting $100,000 from ICBC even with a lawyer and I think the most you'll get is what Johny posted.

My friend was in a serious accident, got himself a lawyer and ICBC basically told him and his lawyer this our settlement, take it or leave. At the end of the day my friend lost money because ICBC only gave him something like $1500 extra with a lawyer and after the lawyer had taken his % he was left with less money from the original settlement.

you should see a lawyer even if its just for a free consultation so you can find out if you really need one. he'll ask you the specifics of what happened, your injuries, etc and from that he can tell you how much icbc might offer. he should also tell you how much he could get should he represent you and how much he'll take as a fee. i had some whiplash from an accident (still effects me), missed some work, went to physio, and the lawyer told me i should expect an offer in a certain range. he told me he could get me more than that but with his fees the amount i would receive in the end wouldnt be much more or possibly even less than what icbc was offering.

k so from the sounds of it i should get a lawyer? haha
i'll go look into that.. and see.
but yah we all survived but what happened was the front rim actually broke
into 2 pieces.. if you look at the pic you can see the tire and rim on the hood of the
car.. it was found on the opposite side of the highway from where we crashed..
it was sketchy and one hell of a long night.

One more vote for talking to a lawyer... most of them that deal with ICBC injury claims will give a free initial consultation, and I think a lot of them also don't charge you unless you collect (ie. they lose, they don't get paid). Yes, there is a risk that you could end up with less after their fees are deducted from any settlement, but hey, it doesn't hurt to ask, or even to ask a couple of different ones.

Based on the initial post, personally, I'd be more interested in going after Acura. Something seems odd there - the rim broke, and THAT triggered the airbags? That doesn't seem right. I'd think something like an MDX should have multi-stage airbags that shouldn't take your head off, let alone knocking the driver unconscious(!!!)

Lawyers only take like 30% of what they get you but its worthe it. I know of someone who got MINIMAL injuries from a lil rear end and was hesitant to go to icbc they got 75k

if you claim and settle before your 19 the governments holds your funds but they thing you dont know about is they will charge you for holding your money. Its the government they will always rape YOU!

The same guy probably bitches that he pays to much for insurance and how unjust it is for ICBC to raise there rates.

Insurance has fulfilled its responsibility to imdemnify you for your medical treatment and loss of wages. However, it's one thing to sue a party at fault. It's another to inflate insurance claims in an effort to gain financial benefit. It's not like the accident has depcreciated your quality of life.

I don't see you having much luck insurance-wise. Canada is not as letigious a culture as America but people of your ways are pushing it. Thanks for giving ICBC another excuse to raise everyone's premiums up. If everyone's complaining about insurance rates, what if everyone followed suit? :rolleyes:
