why am i being prohibited?

Ok so i got a letter which says they want to prohibit me from driving for 10 months, i have already been prohibited once, for 7 months, and i have 21 points exactly on my license

the facts:
been prohibited for 7 months previously
I have a New drivers license
My drivers license has been given back to me
Currently driving


Ok so i have my license currently, and i have 3 points on this fresh license, and i receive this letter, WTF. I looked at the chart for prohibitions within 2 years for previously prohibited new drivers and it says

14-29 points minimum 8 months, maximum 24 months...

I already served my time for most of these points, now they want to prohibit me for another 10, for tacking on 3 points????


3 measily little points, im not even over the limit of 4 for a new driver to be prohibited...

Can somebody explain why this would come up?

oh btw, my driving record if anyone is interested... kind of funny actually, (im sure someone will disagree with me) but everyone makes mistakes, mine just happened to be a lot worse than most peoples average driving record...

As you can see i have quite the record, but i pay for it everyday, in ticket fines, and time served as prohibited, so why the hell would they come after me again for the measily 3 points ?


Haha please dont laugh at this, i know its funny but it sucks at the same time

If anyone is wondering if i learned anything from this, YES i have

I display my N
wear a seatbelt
dont drink and drive
dont speed,etc

apparently im missing the 3 points for driving contrary to restriction btw, a police officer in revelstoke gave me that ticket for not displaying my N, other than that i was not driving contrary to any restriction... for a total of 21 points

no offense, but i think you should of the roads asap, before you crash into someone

fail to stop for police ticket reminds me of GTA when there are 2 or more stars and cops are chasing

also i think you can surrender your license to icbc, and your dpp and points will be gone?

yeah, i would love to sit here and explain the whole situation of everything that has happened to me, but its simply not worth the time, in the end i will look like an idiot, because obviously its pretty rediculous, its just funny because im actually a pretty damn good driver, not that my record would back me up haha :P

You're suspended again because you received another ticket/points during your probation period.

After you have served a suspension, any further tickets and subsequent points that hit your driver's license during your probation time will result in another suspension. This is what the super will likely see and will likely do. Having the amount of points you have, it isn't all too surprising that you were served with another suspension.

I hope that was the answer you're looking for.

^ spot on. i got a ticket 4 months after only a 3 month suspension and got 8 more months. and i thought my driving record was bad lol

Time out during prohibition resulting from any points deducted from your license during your probation = length of first prohibition + at least 2 months.

Learn to read the information that ICBC gives you during your prohibition/probation.

they had never noted that i was on "probation" i never received a letter stating after the first prohibition that i was being watched closely for a certain amount of time... how the hell does anyone drive after receiving a ticket then after being prohibited? basically im going to be stuck with an N for the rest of my life?? theres pretty well no way somebody could go two years without even getting one ticket, that makes no sense to me.

I have been driving for about 5 years now and have yet to receive a ticket.

After every prohibition/suspension, there is a probation period of 2 years (IIRC). I believe it is stated in your first letter or you can read up on the ICBC website.

If you don't drive like an asshole or are not just an overall douchebag, I'm sure you'll get out of your 7N class. But from the looks of it right now and your attitude, you'll be in there for quite some time.

Drive a shitbox till you lose ur N thats the best way.. Like why do you need to speed, will it get you anywhere faster?? Not likely.... If you acctually take the extra 30secs and do all the right things ie. seatbelt, signal and stop at stop signs ect... you wont get any tickets... Go with a beater and get you mind set off speeding.. Best cars are suzuki swifts, you can rag on them and they wont go past 60km/h...

haha thanks dragon you could be right, for the record, im not the wreckless person on the road though, i drive like everybody else, speed occasionally, we all do it, nobody on this site can say that they never speed, etc. Cops do it too, I have had a few of them admit that to me, that even they themselves speed and make mistakes. I realize my record is a little extensive, but the lat ticket with points attached was over a year ago, and i havent received anything since, so i think that says something for my change of attitude towards driving, and respecting the law. Im just sick of how my past follows me

How is it that you're a 'good driver', yet you end up with 21 points? How come 99% of normal people can go 5 years without a single violation? You need to stop making excuses, and man up.

By the way, good drivers stop for the police.

Hate to say it... but it's because of people like you that the Graduated Licencing and Driver's Penalty Points programs are in existence today. But if it means drivers like you are off the road - I'm all for it!

haha yeah, i realize how bad my record looks and it is, but i also think it has all contributed to me being the better driver that i am today. Sometimes things happen thats life, i live and learn from it every day, i was just hoping someone could help me out but i guess were all seeing and saying the same thing, Anyway thanks for your help guys i appreciate it. Im sure if some of you had the chance to actually witness my driving habits you would see that my driving habits are actually more than satisfactory to say the least.

I feel that, fail to stop police is the only thing that he did bad and i think "without due care" and "fail to stop" should just be considered one offense.

The other ones are just carelessness but doesnt really danger other drivers.

It is not unusual to issue VT in circumstances that warrant it. The "drive without due care" is the manner in which he was driving. It may have been speeding & weaving in and out of traffic, it may have been crossing the centre line, no signals etc...that is one offense. When he was being followed by the Police he did not obey the law and immediately pull to the nearest shoulder & stop, as the law requires. Many times I have been following someone who did not stop and I could see them looking at me in the mirror. They then made sudden turns off the road and into a driveway or a side street with no signal. Suddenly ducking into some driveway is a favourite tactic. "I was just visiting my buddy who lives here" ...OK what's his name and phone number, what does he do for a living, what school does he go to. Shall we knock on the door and ask whoever lives inside here these questions and see if they match your responses? It's easy to convince the JP beyond a reasonable doubt that they DID see the Cops...when vehicles around him are stopping and moving aside. If other vehicles could see the Cops then he could. I could have charged them with "cause pursuit" which requires a court appearance for the MV Act...or under the Criminal Code...depending on the circumstances.

To recap...#1...drive without due care. 1 VT ; #2 fail to stop for Police 1 VT. If he stopped as required by law, then he would only have the "due care" VT. We don't know the circumstances involved, only the charges so I'm surmising my response based on general circumstances.

10 years of driving with 1 ticket here... and that ticket is not even a speeding ticket.. is a ticket for my fart can exhaust.. and I live in Richmond...

No tickets in the past 10 years for me. Before that i had 2 speeding tickets. One was for doing 89 in a 50. I learned my lesson from that one and i know i was probably clocked faster but the officer was being nice.

The other speeding ticket was not me being clocked as far as i know. I was going up a 12% grade hill in an 89 Tercel packed to the roof since i was moving. Aparently i was doing 120km/h in an 80 zone and people were passing me like i wasn't moving lol

Besides those two tickets i only had one other one that was stated "unnecessary noise made with tires" I was making a left turn on uneven pavement and a car came speeding around a blind corner, so i stepped on the gas and the tires chirpped since they were wet from leaving the car wash. The speeding car was the cop that pulled me over. Now that was the only one of two a hole cops i have ever ran into.

90% of the time if you treat the officer with respect he will treat you with respect and let you off easy. If you give them attitude then watch out cause i am sure they will most likely nail you with everything they can.

To sum things up the driving without due care came with the fail to stop for police. Other than that i have one speeding ticket which was for me doing 65 in a 50 zone, big deal. Like i said before i made mistakes as far as the driving without due care and fail to stop for police other than that i have never endangered the public with my driving habits.
