Mother fucker hit me: Whos fault?
 
Edit* Pardon my language, i was pretty upset when this happened since this was my first car

Lets play a little game to determine whos fault was it?

So today I was heading down North on Granville street. I'm in the right lane passing cars on the left lane which are turning left. Then right before the Petro Canada on the right side, some guy who was heading in the opposite direction turned left coming into my lane and hitting my from the side. Whos fault is it?

i've attached a visual to paint the picture.

Green = cars in right lane trying to turn left heading northbound on Granville
Blue = me heading northbound on Granville
Red = guy heading southbound who turns left and hits my car

Question.
Whos fault is it and why?

its obviously his fault.. you're heading straight so you have the right of way. hes turning left presumingly into the petro canada.

see thats what i think so too, but i just want to make sure theres no hidden rule of the road he can pull out and use against me,
as for car damage, what do you think would justify whether its a total loss or not?

That's hilarious his bumper stuck onto your car.

File the claim immediately and book a time w/ an adjuster. From the looks of it and the facts we hear, it is indeed the other guys fault.

Keep us updated with the case as well as your cars repair.

Has potential for total loss, but you haven't given us the year or km or your car.

There isn't likely anything he can pull on you, as long as you have witnesses that are in your favour.

once you start mentioning A/C and heater, door locks, alignment, etc..

ur gf and ur 2 frds cannot be ur witness as they were sitting in your car..

You can remove everyone in the car with you as witnesses... has to be third party.

OH SHIT! Alex, didnt know that was you! I was coming back from downtown today and saw that accident. Passed right by it too.

I thought you drove a white integra?? Definately his fault though. Had no idea that was you, didnt see you anywhere.

the person turning left is at fault. If you have witnesses it helps just in case the other driver tries to lie

I'm assuming he didn't since that photo was taken next to the other damaged car, likely right after the accident.

I don't see any traffic control. Other party should be at fault, as you have right of way being through traffic.

I'm not an adjuster, but the damage value would really depend on:
1. suspension and drivetrain damage
2. how badly the door hinge area got mangled and if the A-pillar was involved.

we had to cut it out, other guy had a construction scissors and we also got a knife from petro canada,
and i wasn't speeding,
and who are you solid pengiun? LoL

its bent where the cables are and right where the little hinge is

edit* we also spoke with the witness and he explained that this what he saw

That be more of a write off with damage like that. let alone the cost of the harness that might be damaged may warrant the car a write off.
