Real Estate Question

Can a "secondary dwelling," as in a guest house, be given ownership to a person other than the property owners? If not, would it be allowable if the property was split?

Haha, no.... A friend's parents updated their Will without dealing with the legal aspects of what they're requesting. I tried going through the BC Code website but you're required to pay a hefty sum just to view the online files.

my guess would be that if the will said "they are entitled to the xxx building". that means they can bring in a big truck and take / move the building onto their own property. and dosen't give them the property under it...

the will should probably say "they are entitled to 1/3 of the property, the part under and around the xxx building. then the estate would have to deal with the law on spliting the site or buying each other out.

but I'm no laywer.

But can someone other than the property owners actually own what's legally considered a guest house? I'm too impatient to wait until tomorrow morning to contact my lawyer friends.

From my understanding, no.
This is based on when I asked if I could switch parking spots in my condo.

Basically, the paperwork shows that the house and land belong to whoever's name was written on the transer papers.
What you might be able to do is apply to cityhall for a rezoning permit to split the land into 2.
