People can sue for anything, but whether they have a case or not in court is a different story. In this case, the judge will probably just throw his case out the window. Idiot.

What a prick im sorry for his loss but it aint the search and rescues team fault his misses died skiing out of bounds. Its the snows fault!! Sue the snow, sue the snow!

Just to inject a little sanity here... I haven't read the actual complaint, but from what I recall of the incident, his main issue is that it took so long for anyone to even START looking for them. This was caused in part by miscommunication between the ski resort, the RCMP, and SAR; and in part by the policy of the resort regarding "abandoned" cars left in their lot (ie. how long a car has to sit there before they report it and get a search going for the missing owners). In fairness to the guy, things didn't go as smoothly as they could have in even getting the search started, and very little of that could be blamed on SAR, since as I recall, they DID start the search as soon as they were called out.

But back to reality, those blunders that delayed the search were the direct cause of even BIGGER blunders committed by the Blackburns. In fact, they apparently broke THE cardinal rule - the Prime Directive, as it were - of going into the backcountry during ANY season... namely, LET SOMEONE KNOW WHERE YOU'RE GOING AND WHEN YOU EXPECT TO RETURN!!! They further blundered by ignoring the area boundaries, and apparently blundered yet again by not remaining in one place once they realized they were lost - if I remember the story when it came out, they were finally found nowhere near their stomped-out SOS sign. As I recall, the sign was spotted days before and reported to the RCMP, but with nobody visible nearby and no other indication that anyone was actually in the area and in trouble, the decision was made to do nothing further. If they'd STAYED PUT after making the sign, they would have been rescued DAYS earlier.

Realistically, these clowns violated the top three commandments of venturing into the backcountry, and Blackburn has only himself left to blame.

Guys, guys..

Just because the dood launched a lawsuit, doesn't mean that a) it's going to go to court, and b) he's going to win.

All we have to do is hope that the judge isn't a tool. And any lawyer that agrees to represent him should be shunned at the association level. 90% of lawyers out there aren't going to take the case, because there's a very good chance he won't win!

And yes, the dood is a retard. This is the same reason why restaurants now chain up their dumpsters after filling them up with uneaten but perfectly good food.

Depending on the situation, the resort and association can then countersue. I always thought that as soon as you go out of bounds, your rights to the ski resort are automatically waived. If that is the case, they can then sue him for illegal trespassing.
