So I was rear ended the other day.. The damage to my rear bumper isnt TOO bad, the guy wants to settle privately but my question isnt to related to the procedure or anything like that. I'm wondering if there is any damage to my car that poses any problems (see pictures) I'm a little worried due to the fact my trunk doesnt open and close smoothly, I'm not sure if you can tell by the pics but I guess there's a clip that holds onto the bumper (?) thats dented in, I'm not sure if this is connected to the frame or not.. Anyway, input please http://i13.photobucket.com/albums/a2...g?t=1247988596 http://i13.photobucket.com/albums/a2...g?t=1247988615 http://i13.photobucket.com/albums/a2...g?t=1247988631 |
y dont you just take it to a repair shop and ask them? also how much it would cost to fix im sure they will give u a more accurate answer. also u can tell them to print u an estimate to show the other person who hit u |

The hit was no more than 10km/h, which is why I didnt bother checking the trunk All shops are closed around here on the weekend so I'm seeing if someone here would be able to shed some light. |
take the person who rear ended you to a good shop and let them pay I'm pretty sure a shop like kirmac will charge more than 700 for that pics of the trunk? |

But like I stated earlier I just noticed the damage to the trunk today, so I have no idea how much that will cost to fix, if its a piece that can just come off or if its somehow connected to the frame of the car.. The pictures I've posted already show the damage to the trunk |
^^sorry thought you were talking about the actual trunk lid being damaged what I would do is take off the rear bumper and inspect for dents/irregularities in comparisson to the undamaged side |

Its just the bumper and behind that (absorber, clips, trunk frame) that I'm worried about I plan on taking it to a bodyshop on Monday to get them to take a quick look at it and tell me whats wrong, but until then I'm still looking for opinions here on RS :D |
why dont you take the bumper cover off and see the damage underneath that sucks man, hope you get a good place to fix your baby up |

off topic, but do you have any witness or signed contract? |

But I've called Nissan and they told me in order to order the parts, it has to be paid up front in full, so the guy is just going to meet me there and pay for it in front of me. The only proof I have that he agreed to pay it is text messages unfortunately But overall he seems to be a pretty honest guy All the times I've tried contacting him he's responded with no delay |
you are not at fault, best to deal with ICBC instead, no hassle. |

im assuming you didnt call icbc n report this in? cause you could report it to icbc and the guy at fault just tells icbc he wants to pay out of his pocket rather than going through his insurance. BUT this way icbc records your car for an accident.. well at least you know for the sure the guy's gonna keep his word. also did you get his info? incase he doesnt' keep his word you would know where to find him and able to provide the info needed to icbc |
1) Report to ICBC 2) He can settle privately if he wants to |

Ask if the guy is willing to fix it first I guess text messages count as evidence too So if he says no to fixing it go ICBC his ass If you have it as an accident claim, it's not gonna make a big difference, some $700-900 can show that it wasn't anything too serious |
always report to ICBC to cover your ass for any hidden damage. THe other driver can pay ICBC back |
Thanks for the responses guys, but like I said, the guy already said he wants to settle it privately. I did get all of his info, and I did phone into ICBC. I didnt report the claim YET, but I did ask the lady to make a note that I called in about it (just in case he decided to try to call in and turn it around on me somehow) And that one night that I went out and got rear ended, I was just going out to get gas and I had left my phone at home, so I had no camera on me. But does anyone have any opinions on if the frame itself is damaged? Thats all this thread is really for:p |
1. You have to report all accidents to ICBC, even if he decides to settle it privately. 2. That damage looks like it's going to cost more than $700 |
He can still settle it privately even if you report it to ICBC and go to a claims centre... you gotta protect yourself man... you don't owe this guy any favours... it doesn't have to affect his insurance, he can choose to just pay the claim out. PROTECT YOURSELF... go to ICBC, get it looked at by the claims person, they will see the trunk is damaged and you will be able to fix it properly and he can just pay out whatever the cost is. I guarantee something will go wrong if you keep doing this the way you've done it. |

The only reason I didnt want to at first was because I didnt really want it showing up on my vehicle history, but I'd rather get everything fixed properly |

I always that if you paid for the damage out of pocket (ie from the other dood), ICBC does NOT count it as a claim. Reporting it is a complete CYA move, I can't stress it enough. |
