That's where the section 128(1a) comes in, "unless the stop cannot be made in safety."

It's right there at the very end of the statement.

:rolleyes: this isnt true. Regarding the safe stopping section (which is what is being referred to in your post I beleive) it's the same deal with turning a corner. The Gs are not excessive as what was mentioned and referenced to karting so depending on the road condition (weather, ashphalt condition, camber) I'm sure more than half the people on this forum could do some 90* corners (which are never taken at 90*) around 50kph without any kind of "Tokyo drift-drifting" and whilst staying in the proper lane. You are putting some work into your sidewall to be sure but thats another story.

I like to believe that the police are out there to maintain order on the roads and in society in general.... not some gestappo squad running around to hand out tickets at every opportunity.
Personal judgement is used an aweful lot and if you are pulled over for doing something and asked why I've found you go a lot further explaining your reasons for doing what you did instead of attempting to pull the woll over the officers eyes.


---> I would imagine that going though the intersection when your reason was that you didnt think you could stop safely in time would not be grounds for a driving with undue care simply because you took the care to determine if you could stop safely or not. Driving without due care is more along the lines of... "hey I'm moving though traffic, changing lanes, whilst talking on my mobile and have just avoided a few collisions" not the "hokay, the light just turned yellow and I have 5m to the line; can I stop safely or not? There isnt anyone making a left to clear the intersection and it is best to not to take a chance because of ....(something, driving ability, road conditions, ect) so I will go though". Assuming that at 5m you are at a point where you are unsure that you can stop, at 4m you know that you can not and at 6m you know that you can but 5m? well its a toss-up.

Thanks save me the time posting it.... not sure where people have gotten the idea a yellow light means keep going. It should be treated in the same fashion as a red, NOT a green....... Pet peeve of mine so if I see you do it I will give you a ticket and I am about 199 out of 200 for disputes...... It is also likely one of the major factors in intersection collisions...

well im not talking about EVERY corner..... theres totally intersections where it would work out, at least out here in the valley.

Part of being a good driver is to know when to stop and know when to go. If your passengers keep flying forward because you jam on the brakes at every yellow (this includes right and left turns) then you can't possibly call yourself a good (or safe) driver.

The conviction for running the yellow depends on a time over distance formula. The yellow lights usually have a cycle around 4 seconds. At 50 kmh that would give you roughly 60 metres to stop. You must be able to stop in less than 60m at 50k or your vehicle should not be on the road. If you are physically able to stop but choose to not stop, then you get a ticket. I always drove the intersection first after measuring the distance off. That way I could testify that it was possible to stop in that distance.

The fact that you are speeding above the limit and therefore were not able to safely stop, is NOT a defense. The tickets I wrote were for people who gassed it when the light turned yellow, instead of stopping safely in the distance. I wrote lots for people who had the light turn red before they got there, or just as they entered...usually at high speed. Nice choice to make! Intersections are the most likely place to crash so the last thing you should do is go blasting into them on a yellow or red light.

I was going up Nelson, there was a BMW behind me and he had a lot of room to stop so I stopped. He kept speeding up thinking I was gonna run the light (guess he doesn't understand what my brake lights were telling him). Well, he had time to lay down on the horn and then go around me on the right and run the red light (yeah, it was red by the time he did all that). I really wish there was a cop there that time.
