Car accident in the states. Legality?

What is the normal steps to take when one become involved in an accident? Is it the same thing as if accident in Canada? (Exchange record plate, other driver's insurance paper and driver's license, find witness)

Once the exchange of information is done, we report it to ICBC?

What happened to me was I was struck in a rear end accident. Nobody was hurt except 2 tiny round screw marks on my rear bumper. The other driver (young cute girl) did not have any insurance as she said her car was new and she will buy it next week. She has a driver's permit - which I assume is equivalent to driver's license.

As we both know she is at fault, will be in big trouble if she is caught without proper insurance and we want to settle the case on the spot - we asked for $300 (It was dark out and we have no idea if there is any extensive internal damage on the bumper except for the 2 screw marks). She had $180USD. We took it and we both went on our merry way. Was I being unfair to her?

+1 for calling the cops.

Being unfair? I think you got the short end of this deal. If anything, she totally ripped you off seeing as you could have way more damage than it appears (especially in the dark).

Tell me you got at least her name, number and witnesses. A date shouldn't be out the question either.

Uninsured car with a possibly unlicenced driver, rear ends you and you took $180 cash. My car was hit in an identical impact and it cost my insurance company almost $800 to fix..and the bumper underneath the cover was not damaged. You got taken. Next time call the Police as she could be calling them and claiming you were responsible. They sue for everythig in the US. Even if you are in the right it can cost you a fortune to defend yourself.
