Marine Drive / Grandview Hwy Exit - Xray Check!

Heads up....I was waived through a roadcheck around 10pm on the grandview hwy exit a couple days ago. I did notice 2 cars pulled to the side while police check...all doors were open.

Friends saying there's one also on marine drive...with the olympics coming up...police are checking for drugs and explosives?

Can anyone confirm this? These are busy roads too...how do they decide which cars to check and which to let through...wtf? With these random searches going on...I guess we're going to have no rights for the next month.

car search was probably NOT related to olympics at all. if there was some huge security issue with a particular car, you can bet a lot more police resources would come down hard on the car in question.

are they allowed to do this? i thought legally u cant be pulled over and questioned if u didnt do anything wrong?

If they have reasonable grounds to do a search ex. You smell like weed. Then yes they can search you.

with Olympics coming up they said they are searching for guns and drugs.A friend of mine got pulled over and searched and one of the officers told him it will going on for 1 whole month. Also you cannot refuse the search(?) that is what a friend of mine told me

It's marshal law with the olympics coming up. Still dont know how they're able to scan every car....Be prepared to get 'profiled' now I suppose.

Canadian search and seizure laws are not as clear cut as in the US. Section 8 of the Canadian Charter of Rights and Freedoms states "everyone has the right to be secure against unreasonable search or seizure". However, "search" is oddly defined in court and a lot of it is a grey area.

AFAIK an officer can inspect the inside of your vehicle if he has a relevant reason. This is because it has been established in court that a vehicle is not under an individual's reasonable expectation of privacy. However, the contents of a closed bag/purse (even if inside your vehicle) as well as your home are private, and cannot be searched without consent, arrest, or warrant.

Section 8 Canadian Charter Of Rights And Freedoms

Here is a Canadian court appeal where illegally obtained evidence was thrown out and drug dealers were let go:

In this case a guy was arrested for driving with a suspended licence, and the officer searched his vehicle. The officer stated the reason he searched the vehicle was to find the licence. Since the officer already determined that the guy had a suspended licence via computer search, a search of the vehicle was irrelevant, and therefore drug evidence found in the vehicle was thrown out in court.

They were pulling over cars the other MORNING heading westbound on hwy 1... That was weird.

I plan to do a massive burnout at the cop stop next time.. One tire fire ftw.
