ELKO, Nev. — A Twin Falls woman convicted of forcing a 13-year-old boy to touch her breasts was sentenced Monday to life in prison.
Michelle Lyn Taylor, 34, was convicted of lewdness with a minor under 14 in November after a week-long trial in Elko County, Nev., District Judge Mike Memeo’s courtroom.
With the conviction, Taylor faced a mandatory life sentence, and Memeo set parole eligibility after 10 years, the minimum sentence. If released on parole she must register as a sex offender and will be under lifetime supervision.
The district attorney’s office did not offer a plea agreement in the case, said public defender Alina Kilpatrick, who argued the sentence is unconstitutional and doesn’t fit the crime.
“The jury was not allowed to know the potential sentence in this case and the Legislature doesn’t know the facts,” she said, alluding to the minimum sentence set by the Legislature in Nevada Revised Statute.
Kilpatrick said despite the parole eligibility after 10 years, there should be no mistake that it’s a life sentence for Taylor.
“She is getting a greater penalty for having a boy touch her breast than if she killed him,” she said.
After he sentenced her, Memeo said he was bound by state statute to impose the life sentence, but said he isn’t sure why the prosecution chose to charge her under that statute.
District Attorney Gary Woodbury could not be reached for comment.
Taylor, who lived in Jackpot, Nev., at the time of the crime, kissed a friend’s child, forced him to touch her breast and asked him to have sex with her in February 2008.
Taylor claimed she was intoxicated and doesn’t remember what happened that night. She told jurors she roughhoused with the boy, but didn’t force him to touch her inappropriately.
It sounds really fucked up putting her away for life.
But....
If if it was a 34 year old man forcing a 13 year old girl touch his dick, the sentencing wouldn't be that big of an issue.
I guess law is law. Don't be a pedophile.
^ Even then, life sentence is pretty harsh, no? Like the lawyer said, that's a tougher sentence than many people get for murder. Even if some guy made some underage girl touch his junk, imho as bad as it sounds, that's still nowhere near as bad as if he did other things to her. *cough*
With that said, sucks to be her. I'm sure there will be an appeal though.

dick? the equivalent would be touching the guys breast
but im guessing how this played out (since the lady was drunk and wanted to get laid)
she was probably like "come on baby, fuck me" and grabs his hands and puts em on her tits and he was like "ewwwwwwww no thanks fatty, LET GO" and she's like "come on! squeeze mah tits" and forces him to touch both
(he gets a woody but is still like... no 1st time .... can't.... be... with... THIS)
and runs off

“This is cruel and unusual punishment,”Kilpatrick said. “She put his hand on her boob while she was wearing a bra, now she’s getting life.”
Kilpatrick noted the case of Stacey Thoman who actively participated in the sexual abuse of her daughter , but received a four-to-20 year sentence.
Elko County District Attorney Gary Woodbury said Taylor was "convicted of precisely of what she did," and under the state’ sentencing guidelines, life in prison was mandatory.
Woodbury says Taylor did not want to negotiate a plea deal because she did not want to have to register as a sex offender.
Woodbury says Taylor felt her life would be over if she had to register (as a sex offender) so it wouldn't matter what she was convicted of.
Woodbury says while it might be some adolescent male's fantasy to have sex with a woman, in this case it was a traumatic event. The child has needed, and continues to receive therapy.
i think its justified. the boy is damaged for life now. hes getting therapy at 13, i wonder what thats like.
Lol, i highly doubt that. This guy's a hero in his class, all the guys are probably giving him props for being the first to feel up a girl, then failing him for not going all the way

Yeah... maybe if he went to a school for the blind. Did you not see the mug shots? That's a double-bagger, right there, and not something to be bragging to your friends about.
this case is to prove against people that say female rapist victimizing males only gets a slap on the wrist vs male rapists victimizing females gets a harsher penalty.
i know pedophilia and rape isn't the same thing..but you get the idea.

Yeah it's more than someone would get for murder, but what's the fucked up part about that? Kind of a shitty example because all that illustrates is that you can be given anything less than life for murdering a child.
The pedophile's sentence isn't extreme, the murderer's sentence is too lax.

how was it total fail? i think she did the best she could... made a compelling case
stiffer sentences have not proven to lower nor deter crime
the offender will spend the rest of her life behind bars over something she did while intoxicated... she'll become a dependent and non contributing member of society... wasting away for what?
