Not exactly sure what you mean but I'll give it a stab...in the OP, the Police were there, the OP left with the Police still there and followed them away from the scene. Even IF there had been any "danger", the Police presence took care of that.
If you are meaning what happens to the "illegal driver " & passengers...I already addressed that above. In my personal experience and that of many other Cops, the car gets loaded again & they leave. I have even used my own phone to call a cab for the occupants, only to see the cab leave without the passengers because they didn't want to pay for it and had only agreed to the cab to get the Cops to leave. It all comes down to liability and what happens when things go wrong. Someone else already pointed out that the passengers ( who the driver will be helping out ) will be suing the driver when they get injured in a crash. Taking the keys (under what legal authority ?) doesn't always work. Used to do this all the time to drunk drivers, only to find the vehicle gone as they either had another set somewhere or called someobody at home to bring them more keys. That's why the Govt started the impound process for 24 hour suspensions. By taking the vehicle you are protecting yourself against civil/criminal internal proceedings, protecting the driver against civil and criminal proceedings and the public from being involved in any litigation with an uninsured driver. You also protect the unattended vehicle from being damaged. Yes it means the driver has to find another way to continue, but they knew that before they started and took a chance at getting caught. On occasion I have been able to contact the owner (usually the parent) of the vehicle and they have quickly arrived at the scene. When I explained the liability potential, there was never any question that the driver would NOT be driving away. Some times I knew the driver was in far deeper doodoo that a sinmple VT would bring. I'm not waiting for any long period of time until somebody's buddy who is 25 plus to arrive. I've got to clear and get back to work.
Any Cop will tell you that almost all people they deal with will lie to you to escape being held accountable for what they have done. A very small percentage will not, but we know the odds are that we are being lied to. Based on that alone, you have to act accordingly. |
