I can understand people who change the mufflers to get a different sound or to actually hear the car, but I don't understand the people who mount potato cannon mufflers to the back of their car that are so loud I can hear them shift their rusty CRX into third gear three blocks away. What's the point?
What kind of a VT did you get? There is no provision on a BC VT to show the speed. The charges and sections and indicated penalties are listed but no such thing as you said above. If it was, the VT was defective before it came off the pad and should have been dropped.
It is proper to issue a VT for speeding if the PC was going the limit....or whatever speed, and the other car was pulling away from it. If you can say the PC was doing 50 and the other car was pulling away it had to be doing more than 50. You simply charge for basic speeding...$138. If you can prove a higher actual speed then you charge for that.

Section 83.1 "Excessive Speed more than 60km/h" Is all it says.
That section deals with the liability of the owner for charges. It should have been section 148(1) for excessive speed and the fine of $483 would reflect a speed of plus 60 kmh over. Wrong section is why it was dropped. Junior Member with no traffic experience by the sound of things.
Happened to my Rx8 and it is very hard for the court room to find you innocent on the db reading since you cant put the db reading and your car into the court room together. Failed in dispute for me i was then even worst to get my car to service a warning to be made just pay it. In court it will be worst 50/50 win or lose but lose is when you had to pay + had to change to stock for car service

Nah, it was a old guy. But when I tried to get into contact with him he was listed as a K9 unit which would explain the mix up as well.
^^ LAWLZ at the volvo. When i was 16 i worked at an autostore and my crazy manager at the time had a peugeot. he was running no cats, no mufflers, no nothing. sounded like a rally death car.

Because generally the ERT guys don't really concern themselves with trivial stuff like this... they leave that up to the reven... i mean traffic detail...
I sell parts and get asked this all the time. Sadly all exhaust companies say legal in 50states ect. That is only for emissions not for sound. Really any catback exhaust system could get you in to trouble here in bc. Sadly it is all based on the the officer and well even the kind of day he is having.
For the most part I would gather that we are mostly talking cars here not trucks and suv's. Most car catback systems with silencer in, range from 86-95 db depending on the manufacture. Pretty much making all catback systems for vehicals illegal in bc/vancouver. Although a good comparison if you have a cop giving you a hard time are the guys on thier harleys ripping through traffic with open pipes ... seriously ive yet to hear a car with exhaust that horrible.

K9 does not mean ERT. Most K9's are patrol based, but you are correct that they do not write many traffic tickets

i questioned his ability to 'estimate' how loud it was.
all he said was that its not a v8...i told him its a v6, 3.0 fairly close... i was trying to state my case. i guess we'll see once the time comes
Your car is a Inline 6..... Like a supra. not a v6.

You would have to prove to the court that the exhaust that you had tested was exactly the same as when you were stopped and issued the VI. If there was any time difference between your ride height VI and date you were stopped then that would not support your case.You would also have to call the inspector as your witness and the Crown would have the tight to cross examine him on your contention/his testimony that the car when stopped was identical to when he inspected it. Unless the car sat in his shop and did not move until the Police stopped you then I don't know how that could work. I have had that tried in a few of my trials but the JP did not allow heresay testimony and placed no weight on the unsupported report.
Drivers have been known to "repair" their vehicle, take it for an inspection which it now passes and then "un repair " it and wave the passed VI at Cops when stopped again. The MVA says that Police can order an inspection even if an existing pass certificate exists.
I don't see where you said you got a VT as well as the inspection order?
Equipment of motor vehicles
219 (1) A person must not drive or operate a motor vehicle or trailer on a highway or rent a motor vehicle or trailer unless it is equipped in all respects in compliance with this Act and the regulations.
(2) A peace officer
(a) may require a person who carries on the business of renting vehicles or who is the owner or person in charge of a vehicle
(i) to allow the peace officer to inspect a vehicle offered by the person for rental or owned by or in charge of the person, or
(ii) to move a vehicle described in subparagraph (i) to a place designated by the peace officer and to allow the vehicle to be inspected there by the peace officer, or, at the expense of the person required, to present the vehicle for inspection by a person authorized under section 217, and
(b) must remove any inspection certificate of approval affixed to the vehicle if, in the opinion of the peace officer or a person authorized under section 217, the vehicle is unsafe for use on a highway.
(3) An owner of a motor vehicle or trailer must not permit it to be driven or operated on a highway unless it is equipped in all respects in compliance with this Act and the regulations
No, actually sounds quite nice. Much better than the loud "rappy" sound coming from...well....rusty crx's! hehehe I don't mind the sound as you have.....a tuned system that has a performance sound BECAUSE of performance modifications! I don't like the sounds of a car where someone tries to MAKE it sound like it has performance..yet is still just a "rusty crx". hehehe
You mean that all those Thrush Mufflers I installed in my misspent youth never made my car actually go any faster? Canadian Tyre I want my money back !!!!!!!!!!!!!!
Speaking of loud exhausts, can I call in on a neighbour?
His red Civic is abnoxiously loud and the problem is he drives it around the neighborhood for about an hour for no reason and during that time, he's doing u-turns and parking. According to my wife, she says he just in the parking spot moving it forward and back and that's when the exhaust is loudest (as well as when he's doing U-turns). It's really annoying and it wakes up my baby when she's napping in the day.
I actually finally saw the car over the weekend and asked my wife and she said that was the one she saw.
If I can't call in for the loud exhaust, can I call it in for his front window tint? Seems like he just got the car recently.
I do have to admit that I really like how his car is done up and it's something I'd love to do myself, but his driving habits are what's annoying my wife. She's scared to approach him cause she doesn't know what type of person he is and wants to just call the cops the next time. Just don't know if we can do that cause it's during the day.
