Vancouver pedestrian dies after being struck by cyclist
 
VANCOUVER -- An 80-year-old Vancouver pedestrian died after being struck by a cyclist while crossing Main Street last week, Vancouver police said Monday.

The Vancouver police collision investigation unit is investigating the accident, which occurred about 6:30 a.m. Wednesday, Nov. 17, police said in a press release.

The cyclist was riding northbound in the curb lane of the 3500 block of Main Street when the pedestrian began to cross the street mid-block and was struck.

The pedestrian suffered a serious head injury and passed away the following day.

So the cyclist doesnt have insurance, I wonder how the litigation is gonna proceed. Will he be charged just like a driver? Or as manslaughter?

so it sounds like the 80 year old crossed the street in the dark, not at a controlled intersection, and was struck by the bike rider. doesn't seem like it's the bike riders fault.

To be fair, a some seniors for some reason think that they can cross where ever, whenever they want. I've had a couple close calls where they just step on to the road in the middle of a busy street and expects to be stopped for. Luckily I've always been able to stop in time.
But of course, we don't know the situation of this case.

Nonetheless, always a tragedy. RIP, Vancouver pedestrian.

what if the same thing happens but with a car, will it be the driver's fault?

I can't count how many times I've almost been run down by a cyclist. As they're coming to a 4 way stop, some just ring their bell or shout out while they blow the stop sign with you still crossing. They think it's the end of the world if they come to a full stop. I've even seen some who ride on sidewalks full of people. I hate cyclists both as a pedestrian and as a driver. I hope they make a scape goat out of this guy.

I think it's still going to be 100% fault of the cyclist. It's like a car hitting a pedestrian! It's never the case that the pedestrian came at and hit the car/bike with the end result being death.

lets not get ahead of ourselves, i wouldnt totally blame the cyclist as the senior was crossing mid-block, so he was going gonna J-walk, but then again the cyclist shouldve seen this coming if he was actually looking ahead, so unless theres more info, i say 50/50

Generally from what I have seen, the driver is rarely charged if hitting a pedestrian that walked in front of the vehicle in a non controlled area (no light, crosswalk ect). I’m betting this old guy just stepped off the curb into the bike.

However, it being 6:30 AM, its still dark out, I wonder if the bike had any lights? If not, he may be charged. If the bike did have lights, it’s probably all on the pedestrian.

All in all though, just another reason why cyclists on busy routes or in urban areas should be insured and plated the same as cars.

I'm ok with cyclists, but one big gripe is that if I'm driving on a busy road, and I know that a block away, there is a bike lane set up, I have no idea why they don't just bike there instead. There are so many roads set up for bikes, with bike crossings and whatnot, away from the busy streets... why don't bikers use it??

I don't know either. The streets designated as bike paths have traffic buttons more accessible to a bike, and generally less stop signs in the direction of the bike path. I prefer using these designated streets.

J-walk at your own risk. Especially if it's dark out and you pop out of no where wearing black jeans and a black jacket..Bikers/drivers should not be charged.

Try living in Kits, every friggin yuppy/hippy/bum thinks they are entitled to walk out into the middle of the street, in the dark, in the rain, while wearing dark colours. I'm surprised I haven't killed someone :D

No where in the article did it mention if the cyclist had any lights or reflectors on the front of his bike.

It's sad that the pedestrian passed away after being hit by the cyclist, but what if he didn't see the biker cause that person didn't have any lights on and was wearing dark colored clothing.

As for 91civicZC's comment, does the guy running a yellow light hitting the jaywalker on Nanimo st. count? Or the guy driving the flatbed truck who hit the mother and ran over the baby who was on the middle of the street because of construction across the street from Rogers Arena count?
