Yeah, she was on cnn this morning. It's ridiculous what she's claiming. She complains that nobody went to check on her, but she got right up and walked out of the mall. If I slip and fall out of my own stupidity in a restaurant, get up and walk away, I can't sue them for not checking on me.
Plus the whole identity thing; she contacted mall security once she found out her fall went viral (coworker showed her the video) and the chief said "the video, at least, doesn't show your face". "But I know who I am!" She apparently replied. During the interview she bust the tears out a couple times, saying "you can't understand, it's not FUNNY when it's YOU!"
She's just butthurt and lashing out. An ambulance-chaser managed to track her down and is now doing whatever he can to squeeze a dime or two out of this. Posted via RS Mobile
I'm not a lawyer, but could the error instead be in the fact that the security guards releasing a video of her out to public? and not inadequate railing or check up by security?
Other than that, I see no other erroneous acts by the mall or security; and the above is even grey for me.
^ that would be the best bet. For sure it's not ethical for something like this to be released into the public, which [un]fortunately became viral. At the same time, all this is within a private area, so they may be able to do as they please with their security videos.
The railings debate is not as viable because this is not a common occurance. There is nothing to model the ruling under, it would leave far too much grey area. If, say, she slipped right before hitting the railings due to water on the ground, and they did not have adequate signs to warn her, then that would be a reason for a lawsuit. With her scenario, she just slips at the edge of the fountain.
I could be very wrong, however.

If anyone is at fault for the security video getting released, it's the individual security office and/or whoever else was there. The original video, you can see that it's a guy taping the monitor while other people watch.

I remember once somebody called my work and said he wanted to seek compensation from the City because his car got shitted on by birds as he was entering a parking garage downtown. At first I thought he was joking but quickly realized that he was damn serious about it. Sorry buddy just because this happened in the City Of Vancouver doesn't mean we are responsible. Is that so hard for people to understand that we are just a municipal government and we are not god of Vancouver.

shes not sueing coz she's stupid and fell in the fountain.. shes sueing coz the "security" video got out and onto youtube.
Now lets see how funny it is to guy who leaked this video.. hes shitting his pants.. if he gets caught, he'd probably never work in the security field again...
