Wrongful accusation of a MINOR: (WITNESSES please) Hi Skidmark, We were wrongfully accused and publicly humiliated and would appreciate some advice on how to handle the situation. Should we bring this matter to court? This is what happened: At Metropolis at Metrotown (Burnaby,BC) earlier today (Feb. 17, 2011) between 5:30 and 6pm, my sisters and I wrote our names on a chalkboard (that the event organizers put up), to support anti-bullying, then walked away. A security officer came up to us minutes after, accusing us of "smearing others' names off and writing ours". We told him we didn't, and the man just walked away. Assuming the misunderstanding was cleared, we continued walking until we heard another man yell "STOP!" from approx. 15 meters away. They kept insisting to talk to my 17 year old sister alone but I re-corrected them that she did not do it, also reminding them that they legally weren't allowed to interrogate a minor without parental consent. The security officers kept insisting, then later telling us that we had to leave the premises on grounds that we "erased names off of a chalkboard" (which we did not). We repeatedly attempted to correct the misunderstanding but since the situation was drawing too much attention and my sisters were already getting so humiliated and scared, we ended up getting escorted all the way from the back end of the mall by three officers to the skytrain station, ignoring our requests to speak with the manager. We intend to go back and speak to their manager regarding this matter because we were falsely accused, utterly humiliated, and simply couldn't imagine how traumatized my sisters would've been if I weren't there to stop them from isolating her/them. Any witness who would like to come forward would be a huge help, thank you very much. |
So im guessing they didnt charge you with mischief or anything? They are accusing you of smudging names on a chalkboard??? Definitely contact the Manager of the mall security if not the head office. If they were detaining you in any way, it almost borders on being a "false arrest" or unlawful detainment. |

kinda doubt we're getting anywhere near the whole story here. also, you need to keep your sisters in a cage if this sort of thing would HUMILIATE AND TRAUMATIZE THEM. seriously though, if you think every dumbass getting kicked out of the mall gets to speak with the manager/supervisor etc, then you are pretty clueless. we are escorting you off of private property. mainly because there is a scene being made, well, let's just pause the scene, keep it smack in the middle of the mall while we wait for the manager to attend to the situation. if i have to explain to you why that's never going to happen, then you are a clueless kid. PRIVATE PLACE OF BUSINESS. if there is any higher ups you'll be speaking with, it'll be after, not during the incident. |

Your filing fees alone would cost more than a decades worth of your Skytrain rides. In a situation like this, if you felt you were being mistreated you had every right to leave the mall and you should've at that time. Yes, you may have gone toe-to-toe with an over-zealous security guard but at the end of the day, it's really NOT that big of a deal. I highly doubt your sisters are suffering from any sort of Post-Traumatic Stress from the incident. Either make a formal complaint with the mall management or security management or forget about the entire thing. To be honest, I hardly think it's worth spending any time on it at all. Also, tell your sisters to stop erasing names from chalkboards. There are kids being bullied as we speak because of your sister's actions. |

Seriously... claiming to be "humiliated" and "traumatized" because some rent-a-cop wants to be a douche... is just weak. It's not like he tied you all up and stuck you out on the front sidewalk with a big banner reading "CHALKBOARD VANDALS". You could have avoided the "humiliation" yourself by just leaving; instead, you CHOSE to stay and argue with the guard until he escorted you out, and when you became confrontational, he had every right to remove you from the PRIVATE PROPERTY that it is his job to protect. Thus, you have nobody to blame but yourselves for the situation escalating to that point. At most, you could contact mall and/or security management and tell them you were EMBARRASSED by the guard's accusations... but telling them you were "humiliated and traumatized" will probably just paint you as a bunch of whiners with them... much as it appears to have done here. |

Wow your sisters need to go out in public more if they can't speak for themselves in the face of confrontations such as this and can't handle the trauma of a false accusation from a 11/hour mall security guy (referring to them as 'officers' of any kind is an insult to anyone who rightly deserves to be called an 'officer' and implies a degree of authority that in reality, Paladin employees do not really have). Seriously. Your sisters need to learn to speak for themselves and stand up for their own rights. You need to chill the hell out. Either file a complaint with their boss or leave it alone. |
I would suggest that you talk to the mall manager and see where it goes. If you are not happy with the outcome, take your $ and spend them somewhere else. Mall security does have the authority to require that you leave the premises, and if you refuse, use reasonable force in seeing that you do. While I would like to hope that they would only do so for a good reason, they are the proxy for the property owner and don't absolutely have to have one. |
