| Not getting paid for extra hours put in
My GF started working at a (franchised?) dairy queen for a few months now, It recently came to my attention that they don't have a formal way of tracking how many hours employees work. They will have a schedule ie. You're working 10-4 on saturday, and you'll be paid as such.
It works okay but here's the dilemma, if she gets sent off work half an hour early they're happy to pay her half an hour less. If they ask her to stay an extra hour they're NOT so ready to pay her extra.
Yesterday she worked an hour extra and showed up around 5 minutes late. Manager at the time told her after she got off work that she was 20 minutes late yesterday but because she worked extra, she could come in 20 minutes later for her next shift
When she told me this I was already going  first, she only works around once or twice a week, and I doubt they don't have an actual way of tracking these so-called "show up late minutes", and had it been a different manager working that day they'd probably bitch at her for showing up 20 minutes late. There is no accountability since nothing is written down.
Apparently all the assistant managers/managers are paid like crap too (for all the extra hours they put in) One of the assistant managers have spoken to the higher ups and they choose to ignore him. What other way (besides quitting) could these employees take action?
Just in case anyone is interested, said company is Speedi Gourmet and they operate quite a few locations in pretty much all of the malls in the lower mainland ie. metrotown, pc, rc, park royal, lougheed, etc.

Should ask your GF to think about finding another job.
Sounds retarded to me, that's probably how you feel as well as her BF. She's obviously making very little to begin with and the dickhead manager is trying to milk her extra hours here and there. If the hours aren't tracked properly with a time-sheet, then it's your words against theirs, going to be hard to prove anything.
It's just amazing how retarded companies will do anything to make money from anything, pisses me off.

She likes the people there though and she likes the sense of accomplishment, besides she only puts in 1 or 2 days of work a week so realistically its less than $40 a month difference, but my concern is for the full time employees, and whether they have someone to complain to?

She should talk to the employers about the issue, knowing full well that it most likely means the end of her crappy job. At the worst, she has to go find another crappy job. At the best, they realize what they were doing wrong, and respect her for standing up for herself (yeah right) and start paying her properly.

before she accepts the extra hour, she must let her manager know that if she is staying the extra hour, she expects to be paid the extra hour, if he doesnt specifically say "yes you will be paid" then just refuse the extra time and go home

Also, don't forget about OT pay. Canada has some pretty good larbour laws and I believe if she works OT, it should be 1.5x normal pay. So if She works an hour extra at $10 an hour, she should get $15 for that extra hour. Now, lets say instead of paying her for that extra hour, she can come to work 1 hour late. Time wise it looks even, but you are really losing $5 for the same amount of effort.

I myself have worked at dairy queen in the past and am familiar with the way they handle their business. Because each dairy queen is individually owned(still being franchise), the owners tend not to follow rules as much because they can get away with it most of the time and no one really checks up with them. What she needs to do is speak up to the manager, and make sure he is brought to attention, the concerns she has because noone else can do that for her. DQ is definitely not a good place to work for a long period. I would think of it as a starting job to gain experience. Posted via RS Mobile |

keep track of her own hours for 2-3 months. if she notices difference in pay deal with at that time.
if that does not work take it to the labour board - but that will be the end of her employment.

Yeah, like I said this has only happened once or twice, I still think it's gay how they treat their employees though, there really should be a law regarding tracking down hours, if she tracks her own hours isn't it her word against theirs?
And yeah even her manager can't do shit, the owners choose not to listen...

| OT only applies in certain circumstances - generally, anything over 8 hours in a day, OR 40 hours in a week (depending on the specific contract). Someone working 12 hours or less a week doesn't qualify.

Write a log of how many hours you completed "in pen" at the end of each day. Get the manager or assistant manager to sign off the "hours" and dispute this.
