How to win ICBC claim? I got into an accident on the night of the 16th at Kingsway and Earls. I collided with another car while I was turning left. The car attempted to beat the light while I was turning and we collided. ICBC says it's still my fault when it's clearly not. I was wondering if anyone can help me win the case and put the fault on the other person and possibly get some money as well. Thanks. |
got any specifics? do you have and N? do you have any witnesses? was the light a yellow or red? |
unless the other party ran a red light, and you have an eyewitness to prove it - you're most likely going to be 100% at fault. You should have seen the other party driving towards the intersection. If you couldn't see clearly, you shouldn't have turned. |

Look at it this way: you drove into the path of an oncoming vehicle. Do you have evidence proving that you had the right of way? |
You have to make sure it's safe to proceed before turning. Like everybody said unless you have a witness saying the guy going straight ran a red light you're screwed. If he did run a red put up a sign and hope someone who watched it happen calls in on your behalf. |

Failure to yield...your 100% at fault, ICBC will deem you 100% at fault, and you will be issued a surcharge(increase in insurance around 55% depending on your discount level) sounds like you're a noob driver so it will most likely be around the 55% area |

The chances of you winning in court is low. I wouldnt even bother unless you have two solid witnesses that clearly saw him run a red. The ICBC lawyers will rape your witnesses , asking them detailed questions they might not remember. |

right turners have right of way over left turners... btw, if you wanted help with trying to win, more description about the accident would be more help... by saying what you said "I got into an accident on the night of the 16th at Kingsway and Earls. I collided with another car while I was turning left. The car attempted to beat the light while I was turning and we collided." sounds like it your fault already, and if this is how you told ICBC, then you already admitted that its your fault, then why bother? You cant change your story now that you already told them. Next, take pictures of the accident and note down what exactly happens while its still freash, every and all details are important if you want to have a higher chance of winning. |
^ That's true for most cases but IIRC, left turners have right of way when the light turns yellow. Because the left turner is already in the intersection, right turns have to yield. |
