How to win ICBC claim?

I got into an accident on the night of the 16th at Kingsway and Earls. I collided with another car while I was turning left. The car attempted to beat the light while I was turning and we collided. ICBC says it's still my fault when it's clearly not.

I was wondering if anyone can help me win the case and put the fault on the other person and possibly get some money as well.

Thanks.

Honyoung 10-18-2011 12:12 PM

got any specifics?
do you have and N?
do you have any witnesses?
was the light a yellow or red?

gars 10-18-2011 12:14 PM

unless the other party ran a red light, and you have an eyewitness to prove it - you're most likely going to be 100% at fault. You should have seen the other party driving towards the intersection. If you couldn't see clearly, you shouldn't have turned.

Szeto 10-18-2011 12:22 PM

^what he said. Left turn = 99% at fault unless you have witness or picture from red light camera.

bluejays 10-18-2011 12:30 PM

Attempted to beat the light.. so its a yellow.. and you were turning left.

It's your fault bro :heckno:

Gumby 10-18-2011 01:31 PM

Look at it this way: you drove into the path of an oncoming vehicle. Do you have evidence proving that you had the right of way?

quasi 10-18-2011 02:10 PM

You have to make sure it's safe to proceed before turning. Like everybody said unless you have a witness saying the guy going straight ran a red light you're screwed. If he did run a red put up a sign and hope someone who watched it happen calls in on your behalf.

First of all if you want to win a case, don't post on RS lol

second you sound like your going to milk this case with an injury claim, if your 100% at fault your not getting a dime from icbc.

This is why people should try and avoid collisions where possible even if you think you have the right of way. In this case you thought you did but your wrong.

ruthless 10-18-2011 02:21 PM

Failure to yield...your 100% at fault, ICBC will deem you 100% at fault, and you will be issued a surcharge(increase in insurance around 55% depending on your discount level) sounds like you're a noob driver so it will most likely be around the 55% area

Nvasion 10-18-2011 02:26 PM

your 100% at fault

Presto 10-18-2011 02:36 PM

Call a lawyer.

Unless you have a witness, you're just going to be another ass for ICBC to pound.

No point in wasting her money, this is an open and shut case, she was turning left, other car came in through yellow, other car had right of way. Period. Unless the other car ran a red, and she has a witness to prove it.

Phone up ICBC, and tell them you'll surrender your Driver Licence and take the bus for rest of your life.

It might just work bro.

C5_Ryder 10-18-2011 05:20 PM

The chances of you winning in court is low. I wouldnt even bother unless you have two solid witnesses that clearly saw him run a red. The ICBC lawyers will rape your witnesses , asking them detailed questions they might not remember.

eurochevy 10-18-2011 05:35 PM

you sure your just not a crap driver and don't wanna admit it?

XplicitLuder 10-18-2011 07:12 PM

your at fault man sorry to say. ICBC is gonna be a pain to go through, that's what im experiencing :alone:

illicitstylz 10-18-2011 07:15 PM

fliptuner 10-18-2011 07:36 PM

right turners have right of way over left turners...

btw, if you wanted help with trying to win, more description about the accident would be more help... by saying what you said
"I got into an accident on the night of the 16th at Kingsway and Earls. I collided with another car while I was turning left. The car attempted to beat the light while I was turning and we collided."
sounds like it your fault already, and if this is how you told ICBC, then you already admitted that its your fault, then why bother? You cant change your story now that you already told them.

Next, take pictures of the accident and note down what exactly happens while its still freash, every and all details are important if you want to have a higher chance of winning.

^

That's true for most cases but IIRC, left turners have right of way when the light turns yellow. Because the left turner is already in the intersection, right turns have to yield.

Um wtf? "Hi I'd like somebody to magically win the case, put the fault on the other person, and then I'd just like some extra money, just because, please?" As has already been said, you are at fault unless you can prove otherwise anyways...

By your own words, if the other "car attempted to beat the light", that means it was still yellow, and you tried to turn before the oncoming traffic had clearly stopped.

As for the part in red? I'm hurting I'm laughing so much.
Who taught you how to drive?
:fulloffuck:

Also...
1. Are you asian?
2. I can't believe I'm risking life and limb being on 2 wheels with drivers like you.

FerrariEnzo 10-20-2011 12:21 AM

i think we all scared her off
