Owner of Three Vancouver Subways named worst boss.
 
Thumbs down to this boss for requiring staff to sign a form with the following agreement:

I, ______________, understand that for any hours worked past 8 hours per day, I am entitled to overtime pay. However, I acknowledge and agree to waive any overtime wages due to my request to work additional hours per week.

I hereby request additional work hours per week without any overtime pay.

I had this kind of agreement at several part-time jobs when I was a waiter before (although it was a verbal agreement). Simply said I will not work more than 8 hours per day and it was all good for me.

when news1130 called the owner he said he was simply a franchisee following the rules and welcomed the govt. to check; implying that it was a franchise (subway) rule

when subway was asked for comment they refused

have u guys read that? i dont really see a problem because that something u sign when YOU request over time. NOT if the boss asks you to work it.

Doesnt make sense from the owners P.O.V to pay me 8hrs + 4hrs over time. when he can just hire some one part-time for the over time?

Thats like me asking my Boss, "Hey im done my 8hrs, im gonna stick around and work another 4 so u have to pay me 1.5xhrs ok?"

meh.

some places cut your hours off even if you've worked over the "threshold" that they wanna pay you

8 hr shift, 45 min break, should be paid for 7.25h, but you stay an additional 1 to 2 hours because they need you and they only pay u for 8h and no OT

mcdonalds does that in hopes employees dont see.. in other words modifying when people clock in and out

What's worse than getting paid straight time for overtime is.... working overtime for FREE. My little brother worked fro A&W a few years ago. Told me clean up time is not paid but expected to be done after work.

I know someone who has signed a similar agreement.
There is nothing wrong with it in my opinion.

In the case of the person I know, he wants to work more hours (more than 40h/week). The boss said he can't afford to pay overtime so he can't let him work more hours. But, my friend said he doesn't care about overtime pay, he just needs more hours.

So in instances like this I think it's okay since the boss is helping him out. But, if the boss forces you to do over time, you should be compensated as such.
I think it just depends on the circumstance.

So it seems like the employees were requesting extra hours. I don't see what the problem here is? The employer CLEARLY informed the employee of the situation and the employee agreed. I don't really see what the problem is? As far as I'm concerned, the employee(s) are being bitches.

I was a manager for Subway for a couple of years before I went to school.

Um. Let's see.

As a manager I was expected to make sure the till was even with sales. So if one of my employees lost $10..I had to pay it.

As an employee, if you lost $10, you were supposed to pay it(so I didn't have to)

Sometimes there would be an overage in the till. That became the "rainy day fund" for when the till was short. Sometimes we had to make it rain because I was sick of topping it up. Guess how one would make it rain.

If someone dropped a fake bill in the store, it was "suggested" that I go and bomb another place with it so that I didn't have to pay it myself.

Oh. Food cost was everything. So we didn't throw stuff out. Tuna not a big seller? That's ok. There are more people tomorrow.

Cheat the meat. Enough said.

Yeah, I don't feel so bad for a guy that wants to help you out with more hours, but can't do it without paying you overtime. If you want overtime, I'll just hire another kid at straight pay. Your choice.

my understanding is that the overtime cannot be waived, as in that agreement is void. The employee will win his overtime pay. Read section 4 Employment Standards Act.

Employees sign the form in fear of getting fired. Standing up to your boss in this situation is intimidating, if you do, you will probably get fired. A less fortunate person may really need the job and isn't willing to sacrifice it. It's also plain and simply illegal as stated in the Canada Labour Standards Hours of Work and Overtime Pay

This Anil dude is called the worst boss based partly on the fact this organization EARN (Employee Action Rights Network) gave him a "BAD BOSS" Award certificate. If you look at the picture in the article, three people give this huge "BAD BOSS" certificate to Anil.

Someone is screwing Anil over with a giant award certificate, :p
