settle accident outside icbc.

To cut it short, i got into an accident and both party agree to go pay off the damages privately.

I am in the process of writing a form/contract so that the other party and I will sign off to so that we make sure we are firm on our repair cost. Just wondering, if there is any template or any suggestions on things I must have on the form?

I just don't want to deal with any BS AFTER the cars are repaired.

who's fault do you think the accident was? I would always say go through ICBC due to problems with alignment and things you can't see with your eye.

It's always safer to go through ICBC.

to cut it short - don't do it unless you are 100% and i mean 100% they won't fuck you over afterwards.

always go through ICBC. they are there for a reason. unless you're the one at fault..

if you still insist on dealing privately then i'd probably suggest asking an attorney to draft a legal contract or something like that. but going through ICBC is safer, more fair, and protects everybody.

Any form is useless in most cases, the guy can just tear it up and go to ICBC to claim again. With technology these days, you mind as well record the person saying I am so and so and I swear I won't sue blah blah blah.

I turned to another lane and the car was at my blind spot when i turned.

So will I be 100% at fault? I do feel like he accelerated and could have seen me turning...

Anyways, if I file it through ICBC and ICBC states i am 100% at fault, can we still settle it privately without getting dinged with premiums?

I Feel like the fault is mostly on my side. However, I also don't want the other guy to screw me over and give ICBC BS about having injuries/more damages to the car, etc...

Just go through ICBC and opt to pay back ICBC the cost

so to "opt to pay back ICBC the cost", it means I am paying 100% of the repair for her car and avoid any changes to my insurance premium?

both parties can go through their respective insurance companies and can pay off the damages instead to pay higher premiums.

doing it off record can also come back and haunt u. As long as the contract states the PROPER informations from both parties, should be ok.
Also stated that the person shouldnt claim any injury in the future, if they sign the contract.

How are you guys going to pay and know how much to pay?


If you go ICBC and be 100% at fault, it will most likely going to cost you and they can claim for injury.

Lol... you changed lanes into another car. Unless you have a video and eyewitness showing he accelerated INTO your car, you are absolutely fucked. It is 100% your responsibility to ensure the coast is clear when making a lane change.

That's correct, your position on the CRS will not move if you pay for all of the repair costs. Unless they claim injuries.

Both of you should go get whatever you write up notarized and both of you keep the original copies as does the notary. Then you will be protected from any shadyness afterwards.

Just went with ICBC in the end. The other driver acted all sketchy today tellig me they are being quoted 1400 to repair, then called an hour later saying is 1700...
