US Marine beats the shit out of a taxi driver
 
The US Marine Behind This Brutal Attack On A Cab Driver Won't Be Charged With A Felony

Island Taxi in Surf City, NC recently installed video cameras in all of their taxis for the safety of their drivers. Early Sunday morning, one caught a passenger, who happened to be a US Marine, beating his driver to a pulp.

And after all that, the Marine won't be charged with a felony.
The video shows cab driver Charles Hawkesworth Jr being attacked just after 1 AM Sunday morning by 30-year-old Gunnery Sgt. John Adam Kinosh for taking him to pick up another passenger.

The Island Taxi dispatcher explained the protocol to JDN News.

We were trying to turn a $25 fare into a $12 fare for him and he got all upset. From what I understand (the passenger) was pretty intoxicated.

Hawkesworth offered to just drive Kinosh home, but the marine tells him not to act tough, that Hawkesworth is trying to take his money, and he tries to take the keys. Hawkesworth says he's not trying to take anything from Kinosh, who then starts punching him. He then exits the car and returne to yell at Hawkesworth, but that video has not yet been released, reports JDN News.

Hawkesworth suffered multiple fractures to his face and received about 15 stitches. He has been discharged from the hospital and is resting at home.

Gunnery Sgt. Kinosh checked himself into a psychiatric hospital. Island Taxi owner Rex Bowen asserts it is to avoid being served with his warrants for misdemeanor assault inflicting serious injury, assault inflicting serious injury and communicating threats. Since Kinosh did not use any weapons, only his fists, he cannot be charged with felony-level offenses.

Bowen told WECT 6 News how the incident strikes him.

I've been in business here for five years and I've never had an incident like this. I started this business as a way to get people home safe. What happened is just senseless.

There is currently a "Help Charles Hawksworth" Facebook support page. He is an example of how difficult and dangerous working as a cab driver can be.

Wow this marine asshat punches the taxi driver in the face around 10 times or so (probably with more force than an average person as well) and says he was assaulted by the taxi driver when he tried to get his fare which was probably a touch on the hand.

Really? Probably going to get just a slap on the wrist :seriously:

well if that's what the law says then that's what it is. what he was trained in has no relation to the case. so you're saying if someone's a black belt in a martial art he should be charged more severely than a regular person?

Apparently that might be the case sometimes. I remember when Jason Miller was interviewed he got in to a fight when he was younger and was charged heavier because he is a professional MMA athlete. Something like in that state he is considered a dangerous weapon. This was before he was a famous MMA star

You go after him on a felony charge because he was a trained marine, and his defense will be not criminally liable because his training caused long-term changes to his decision making abilities.

Throw in a little PTSD from multiple tours and a made up drinking problem and score! scott free! Maybe pepper in a little "gotta support the troops" patriotic propaganda in the media for good measure.

He was clear headed enough to accuse the driver of hitting him first so he could say he acted out of self-defence if the driver ever call the police

The driver could go after him in a civil (tort) action... Numerous cases of police brutality ended up like this (no criminal offence charged, but civil action succeeded)...

I would do so! Like damage to the body, damage to emtions, sick days, medical bills and then sue the marine since I am scraf for live coz of this I can no longer do my job as a taxi driver and just sue the marine till he is bankrupt?

Of course he can. But he might as well go for a bigger lawsuit and sue the Ministry of Defence! They have deeper pockets and are vicariously liable for the conduct of their personnel...

He could sue for medicals, loss of opportunity (to earn money), damages and so on... Just because criminal prosecution is not effective, it does not mean that the civil lawsuit is not either...

BUT, we will probably never hear about this case if it goes civil and it is highly likely that the parties will reach a settlement under the media radar (especially since Ministry of Defence is involved).
