"Resisting" Arrest

So my friend Andi was riding his bike home (sober) 3 blocks in Yaletown late last night without a helmet or light on. He went through a red light at the bottom of Robson and Beatty as there was NO traffic there at all (3 way intersection in front of the Terry Fox Memorial). These cops pull him over, and this is what they do to him. I have a full 10m video, and I'm recommending that Andi presses charges. Please help prevent this sort of stuff from happening again by sharing this video / photos, and asking the VPD to investigate VPD Officer Bhabha #2703.

This can't be proper police training...

edit* not arguing that he was in the right in regards to riding without a helmet, lights and running a red light on a bicycle but in my opinion he did not deserve to get punched...if he was resisting then they should have taken him down, no need to punch him

Until I see the full video, ill keep my police hating comments to myself :lol

Riding without a helmet or lights and runs a red. You can't really expect that not to be stopped.

This is no excuse for excessive force but lets not try to paint him as a saint.

StylinRed 03-27-2013 11:58 PM

the story is on news1130 too

he was stopped for no light or helmet, running a light and supposedly there was an argument that escalated into him being cuffed

and in the video you can see he keeps moving his arm when the officer is trying to handcuff him the officer gets fed up (probably because of the argument too) and punches him

he can get away with saying he resisted because well he did the point that can be argued is if his force was excessive (probably not)

like one of my old professors used to say you could be in the right but there's no point in challenging an officer about it, especially in the middle of the night, because you may get beat leave the arguing for your lawyer in the courtroom

knight604 03-28-2013 12:00 AM

The other officer didnt think that he was resisting so why is guy who punched him thought it was necessary?

EmperorIS 03-28-2013 12:03 AM

Brown guys with a british accents are so trippy

bballguy 03-28-2013 12:07 AM

I don't think you punch a guy to get him to stop resisting...........Cops are supposed to take a guy down, not throw punches.....

why do you say that? i didnt watch the whole video did the other officer say he didn't think he was resisting?

either way it doesn't matter the british cop (i know its local) felt that he was resisting (and he was by constantly pulling his hands apart which supposedly the officer had warned him about)

edit: why the fails?

knight604 03-28-2013 12:20 AM

He didnt NEED to punch him in the face , that would probably make someone more aggressive than calming him down.

If the other officer thought he was a threat , maybe he would of held him down with more force but it didnt seem to be that way.

bballguy 03-28-2013 12:25 AM

HOW CAN HE PUNCH!?!?

YTMND - How Can She Slap!

you can see him trying to pull his arm away before he is punched, when you never know what someone might do ie going for a knife or gun this is completly resonable i think. So either he should have been pulled over his shoulder and thrown to the ground or get a quick punch to the face which id take the punch lol

You are right he should have been tazered instead.

Not really racist! 03-28-2013 12:54 AM

That has to be more to that story.. lol you don't get fucking cuffed for not having a helmet or running a red light as a cyclist

I don't believe it was just "that" simple

rsx 03-28-2013 12:57 AM

he did pull away his arms and like some said he could've been pulling a knife or weapon.

I think to avoid problems, the SOP should be that cops instruct them to kneel down with legs crossed and arms behind the head. if they don't comply then consider it resisting.

Dude in the video the guy being cuffed is clearly not trying to pull his arm away, he's trying to readjust his arm like he explained later in the video. If you watch the video he wiggles his arm and moves it slightly to his left (probably 2-3 inches over) over the course of almost 3 full seconds. If he was trying to resist he would have snapped his arm away which would take at most 1 full second.

bballguy 03-28-2013 01:11 AM

Exactly...Why would he stand there with his arms behind his back letting them put a cuff on one hand and then all of a sudden decide to resist...that wouldn't make much sense...It's more likely that his arm was being pulled into a position that it just wouldn't go and he was trying to adjust....

CharlesInCharge 03-28-2013 01:55 AM

What an ugly city, even from the news site comments.
If you're not rich, expect to be treated like a second class citizen or worse if you're mentally unstable, expect to be executed like Boyd with every officer on the scene involved in the coverup of your murder.

ilvtofu 03-28-2013 02:05 AM

It's very convenient that the video basically starts with the cop throwing the punch.
Would be interested in finding out about the officer's history, if any, regarding abuse.

$_$ 03-28-2013 02:33 AM

Show the full video if you want to really get our opinions on who we think is right or wrong. Don't feed us half a video. His attitude prior to getting to the point of being handcuffed is crucial to how the officer might respond. If he was displaying signs of aggression before getting handcuffed the way he flinched while getting cuffed would warrant him getting punched/subdued.

Edit: I re-watched the video over a couple times again and think that the way that the officer punched him was a bit unwarranted. He could have still be in control of the situation without having to punch him in the face. It would have been quicker to regain control of him by grabbing his wrists (like he was doing) but instead he brought his arm up above his head and went for his face. It's hard to say in the heat of the moment what's right and wrong, but I don't know if I would call what that guy was doing resisting arrest.

Again. Show us the whole video and let us make that judgement.

+1

People would be getting cuffed left, right, and center if it was "that" simple.

My guess is that he wasn't co-operating when the cop pulled him over.

The punch was unnecessary, but if he was mouthing off and getting in the cop's face... who knows what it could've escalated to

Who says he is a saint? They are just giving more of the story. Usually you don't get that at all.

So they admit the cops had good reason to pull him over. That is not something to complain about IMO

However I am not even going to watch anything unless it's the full video

drunkrussian 03-28-2013 04:48 AM

only reason he acted like a saint is cause his friend w filming and they wanted to make a stink with the media. He clearly was moving when the cop was trying to do his job. You can't take the risk not to act on it

In not gonna show sympathy for some asshole running reds with no helmet then trynna get five mins of Fame out of it

It didn't seem excessive to me, he pulled his arm away and he was hit once. What lead up to that moment? Like others have said I'd like to see the part where he did something to get to the point to be cuffed. You get pulled over for disobeying traffic lights they generally don't throw you against a pole and cuff you for a citation.

Mean awhile on main and east Hastings............
