ICBC wont accept the statement....had it happen twice. The difference was there was a person in my car that witnessed the events.....didn't have to lie.

Unless there is a witness of this accident or the driver admits fault the OP is screwed and will be taking the full hit of this from ICBC. Even with a witness to the events the other driver can state that they did not reverse into the OP and then you have another battle on your hands.
Time to invest in a dashcam.

Fraud does not beat fraud people. Faking witnesses can land both parties with a fraud charge and then no coverage.

whether the truck passed the line or not (it doesn't determine that he reversed). For all we know the truck person could say, OP didn't stop for stop sign and rear ended me. Without video footage or witness, the person in fron't of the accident usually wins

wow thats absolutely sucks for the OP, hope they can do something for you bro.

the other driver will get whats coming to him. I have been looking at dashcameras for months, this will definitely propel me to get one asap.

same shit happened to my friend many years ago. got screwed over by the guy that caused the accident. moving forward i would suggest at the very least a $35 ebay cheapo camera. even that would have recorded the douchebaggery of the pickup. i've been rocking one for a good year and though you won't catch plates unless right behind a guy at a red light, you'll still catch stuff like in OP's case.

One thing that I would also suggest in the event that something like this happens again, bust out the cellphone and video tape everything from the moment you leave the car to the moment you get back into the car.
Report the incident while you are still on scene, and always call the cops to an accident. Especially something like this.

Get a police report #, and statements from both drivers will be taken. Being that you were backed into there needs to be some photos and things taken. Car positions are largely important. The impact marks from a car hitting the rear of another and one being reversed into are different.

Fight the ICBC 100% at fault thing, if they want to pin it on you get legal advice or get a lawyer. If its not your fault you should not be paying anything.

There is one way that ICBC may be able to determine the true at-fault party. Theoretically if you hit him, you should have been braking. This means the front of your car would have been diving down at the time of impact. If the truck was backing up, depending on his speed, his ass end may have been higher than normal. If they line up the two vehicles and try to determine where the point of impact occurred between them, they may end up ruling in at least partially your favour. It's a small hope but it's there.

Good luck and I recommend you invest in a dash cam. Even a shitty one that records in SD is still better than nothing.

I know this is just a "theoretical" thinking..and full of "what if"...

But what IF on the night of the event, the OP walked up to the Fraudster after being hit; and pulls a bluff by saying, "Hey buddy, I've got a dash-cam installed, you wanna explain what just happened?"

By pulling a bluff, the Fraudster might either demand to see the dashcam, OR pony-up and pay for the damages. Correct me if I'm wrong, but the bluff would put the Fraudster on the spot and put his mind in a frenzy...

Wow, something similar happened to me when I had a 97 GS-R. The guy who backed into me called me to ask for a private settlement, and when I declined, he told ICBC that I hit him! Fortunately, my adjuster was able to argue the case in my favour, but I don't remember what evidence (if any) was used.

Without getting into details, would your "insider knowledge" have worked with my 97 GS-R?

OP PM'd me his car details, and unfortunately his car is a little too old for me to help him.

Short version, I would have had OP tell ICBC that someone is going to read out his EDR (event data recorder) which he believes will show a vehicle speed of 0 and foot applied to the brake at the time of the impact and for a couple seconds before. This would prove the other vehicle backed into him. That would really perk up ICBC's ears. Only in this case it wouldn't be a bluff since OP would have someone who could do this for him (namely, me).


I'm against lying to ICBC, fake witnesses or fraud to try and win your case. But I'm not against "bending the rules" a little if it means some scammer gets caught.

To the rest of RS, no, I'm not going to start scanning everyones vehicle who contacts me (I can't abuse my access to this ability). I just happen to know someone who had this happen a little while ago, and felt compelled to offer any help in this case.

Thanks dangonay for trying.

Thank you RS peeps as well, with all your feedback and help, this restore some faith in mankind knowing not everyone is a jackass.

I'll be going into ICBC Tuesday and hopefully from the damage on my car, they may be able to piece together something showing I was not @ fault.
