Getting screwed over by ICBC Hey guys, I was backing out of a Safeway parking spot a few days ago in my neweser(2007) SUV, when an old man backed into me. I was just about to put the truck into drive and pull away when I noticed in my back up camera a car about to hit me I honked and put my truck in drive but he still hit me. He folded in my bumper and cracked and stressed the paint and also damaged the rear tailgate/hatch. There is a dent and scratch about a half an inch over from where the bumper was hit. So we exhance info, the old guy admits it was his fault, while Im talking to ICBC a guy comes up and says that he saw everything and it was 100% other guys fault. So I go to ICBC today and the estimator is saying that there is no way the damage on the hatch could have happened in the accident. I tried to explain and be rational, but the estimator just shrugged me off...I didn't wait to fill any paperwork or sign anything I just got in my truck and left because I was so mad I didn't want to make a fool of myself. I immediately called the 24/7 claim hotline and express my concern, she transferred me to the supervisor of the claim center I was at. I finally got threw and the supervisor said that after reviewing the pictures he too doesn't see how the damage could have happened. Everyone who I have told is in disbelief with this, I even have pictures of the truck a few days earlier with NO DAMAGE... After some talking I managed to get an appointment with the supervisor tomorrow morning. So my question is have any of you had a situation like this with ICBC. Damage caused in an accident that ICBC didnt want to fix? or can you point me in the right direction with a good ICBC lawyer if I cant get them too see the damage was caused in the accident? I feel hopeless because common sense seems to be something anybody at ICBC is lacking so what the hell can I do to prove my point? sorry if this is in the wrong forum/is a blabbering mess kyle |

Hey guys i really appreciate all of the replies. I am posting this from my phone so i cant post any pictures. But if you have instagram my page is /1bade55amg and the 8th picture down shows the damage. If somebody sees and could pull a solid and get the url and post the picture here that would be awesome... without seeing the other car and its rear design I can understand ICBC's reluctance to pay for the tailgate. I do not understand how the tailgate would be damaged like that either. Im going to take the OP's word that it happened in the accident, and if he really does have a picture of the car without that damage 2 days ago then most likely he is not lying. The main way I have seen that type of damage is from the tailgate hitting like a sprinkler head in an underground parking garage or something like that. |

Hmmm...I have a good idea. If they are disputing that the Intrepid could not have possibly caused that damage then I would say prove it! At our shop we have a 2000 Chrysler Intrepid just sitting there (customer left it and took his plates). Come to our shop, back your truck up to the bumper of the Intrepid and take a bunch of pictures to show that the damages could be possible. There could be some good ammo there. |
^ JUST BE CAREFUL you don't even TOUCH your damaged bumper to the intrepid, they could then claim some of the damage was from that. |
