Drunk/High(?) Hipster Throws Sideview Mirror at my car

Hi RS,

While I'm a longtime lurker and not really an avid poster, I have enjoyed this community in the past few years that I have been on here.

Hoping to get advice from some of you regarding my current ordeal.

So I'm driving north on Expo/Quebec (just merged on there from Main coming from Kingsway), to pick up my gf from Granville St. when a drunk/high guy dressed like hipster, out of nowhere, throws the sideview mirror (that he ripped off of a Nissan Maxima that was parked on the side of the street) at my car!

I heard immediately a loud thump, and did not know what had just happened. I slammed on the brakes (this was around 3am and I was the only car on the road). Fortunately for me, a couple of homeless guys witnessed everything and came up to my car right away, informing me some guy threw a large car mirror at me and was making off. I pull over and dial the police while one of the homeless guys (on a BMX bike) offers to chase after the hipster guy to make sure he didn't get away. Thanks homeless guy! (for real, he was a nice dude).

Luckily, the cops showed up really quickly and they actually apprehended the hipster guy, with the help of my homeless hero on his BMX bike. While I wasn't injured, I take good care of my stuff and it really pains me that, for no reason, my beloved MX5 was damaged by this hipster bozo.

The police arrested the hipster guy, interviewed the homeless witnesses, and gave me a case number to reference for ICBC. I already called ICBC and have an appointment with the adjuster this week to look at my car. I'm worried as I only have basic coverage for the vehicle as I really only drive sometimes on the weekend. Should I lawyer up? Seeing as the hipster guy was arrested, I should be able to get some money out of him to fix the damage? Anyone been in a similar situation able to give me some advice??? I've attached some pics, hopefully if anyone knows this hipster guy, you can tell him he's a real asshole.

I offered him some change, but he actually refused it! He told me he was homeless, but he wasn't drugged up/smelly homeless, just some middle aged guy on a BMX bike. He said he had a car he cared about back in the day and would've hated to have had this happen to him.

Looks more like a dumbass young adult then a 'hipster'.

Never been in a situation like this but from the picture it does not look like the damage is that bad?

Good luck and i hope the drunk pays for his stupidity.

Damage is not huge, there is a dent right where the crease is on the fender flare though, which I'm not sure if it's hard to fix or not. Still, who does that though? Like ok, your drunk and want to blow off some steam, go pick a fight or something. I also feel bad for the owner of the Nissan who now has to replace both his/her sideview mirrors (they were both ripped off by this guy).

I labeled him a hipster because of the tight fitting leather jacket, haircut, and the area we were in.

Brutal. You are lucky you have a good witness! Hopefully they charge him with mischief and hopefully the charges stick.

If you have comprehensive coverage, that will cover the damage, but unfortunately you're still on the hook for the deductible.

If you don't have comprehensive coverage, then your only recourse to recover the costs of the damage from this guy is to either pursue in small claims court, or hope if the judge finds him guilty of the charges and orders him to pay you restitution.

Ya, if I ever see that homeless guy in the area, I will definitely hook him up. Unfortunately, as I mentioned, it was 3am and nothing was really open. Also, my gf was waiting for me on Granville so my options of helping out the homeless guy were rather limited.

Is there any chance ICBC would go after the guy on my behalf to get money from him? Since the cops have all of his information? The reason I ask this is cause they lady on the phone from dial-a-claim didn't mention anything about my basic coverage or anything like that, instead, set up an appointment to see adjuster and sent me a list of bodyshops near my house.

Glad they caught the guy and there's good homeless people in this city. A couple years back my car was hit while parked in a parking lot behind Granville St. Some homeless dude left a note on my car with the license plate #, don't know who it was but another homeless guy came up and told me it was a guy that walked around helping people finding parking spots.

And one thing about driving late at night in DT is always keep an eye out for drunk asshole especially on the weekends. I had some young punk run in front of my car 2 summers ago on Robson for no apparent reason but I suspect he wanted to get hit to collect insurance money just the way he darted into the street and how he had his body positioned. I slammed my brakes, rolled my window down and went ape shit on him, he looked at me and ran off. It's one the most bizarre incident I've encountered while driving.

ICBC will pay to get the car repaired and then they will pursue the matter in whatever way they see fit on your behalf, this may or may not be legally, or they could just decide its not worth it and foot the bill.

I had someone else recently try to explain to me that he wanted to recover loss of value of his vehicle by sueing the guy in small claims court, but that is simply not possible. Loss of value falls into the "pure economic loss" category. Which is automatically exempt from small claims court.

So basically unless you want to turn this into a criminal case, there is no way to re-coup anything here.

If none of the above makes sense here: ICBC will pay to fix your car as it was before the incident. My recommendation get over the incident and all that emotional scarring, and move on. Because you are just going to waste a bunch of your own time and money pursuing this further only to never see any real resolution.

small claims court

you can sue him for damages to the car, rental fees and court cost. if hes been charged hes guilty and should be a pretty simple case. or try to get ICBC to sue him.

im not sure if you can get his contact info but if you could let him know repair bill is $$ and you request that he pay it or your deductible or you will pursue it in small claims and in that case it will cost more money
