Are school zone speed limits in effect on strike days?

Just like the title says, are school zone speed limits in effect on strike days?

I know they're in effect on pro-d days, how about strike days?

Since kids are still present, I would ASSume the 30km/h limit is still in effect.

Only a couple of weeks til school's done anyways, so you'll only have to slow down for signs with Summer School under them.

Why not just play it safe and slow down to 30 anyway? Unless you're bent on taking out some picketers.

I got a letter from ICBC for my riding school today that the reduced speed 30 kmh zones are in effect until after June 27th.

@BurnabyRCMP: Good question @jimmy_said_this! School Zones only in force on days school is in session. Regular speed limits apply during the strike. sc

^^ That.

Figured 30km/h is only in effect while kids are in school.

Still, doesn't hurt to play it safe and slow down anyway. It's only for a few hundred feet.

Going back a while, but I think it was Zulutango who once posted up that school zone speed limits are in effect on pro-d days.

I think the wording of the MVA was such that the definition of a school day was ultimately explained as a day that teachers were required to be at the school, not a day where kids are required to be there.

Even though school's not in session, due to the strike, kids are still doing finals.

By the time we have a concrete answer (not speculation or a tweet), June 27 will have come and gone and the teachers will be skeletons on the picket lines.

Pretty much.

I think it was a bad idea to send out that tweet.

FYI...this is the official word from ICBC...Burnaby RCMP are mistaken if they are saying you do not have to slow to 30 in posted zones during the strike.

School zone speed limits during labour disruption
Today (Tuesday, June 17, 2014) is the official start of the province wide BC teachers strike.

During this labour disruption, ICBC driver examiners will be expecting drivers to obey school zone speed limits up to and including June 27, 2014 — so it’s important that you advise your students to drive at the appropriate speed while taking their road test.

If you have any questions about how speed zones apply during road tests, contact your local driver licensing office.

Please share this information with your staff and encourage them to check for important news and updates on our driver training web site dtcbc.com.

^That doesn't actually say "school zones are in effect"... just that examiners will be expecting students to follow them as if school is in session.

I was thinking about this too. Yesterday I was travelling in a school zone when I see a police car pull up behind me. Decided to play it safe by driving 30 but he ended up tailgating me in a somewhat impatient manner. Maybe he was on a call though so who knows.

At great risk of being buried under heaps of derisive scorn...why would examiners expect students to follow them as if school is in session...if they were not legally in effect? The same examiners (who work for the Supt of Motor Vehicles...ie the Govt) who will fail you for a "Violation" of speeding anywhere else, running a red, crossing a solid lane divider..expect you to follow the school zone reduced speeds because it is the law.

What I quoted you was a cut & paste from an official Govt bulletin to me at my driving school. After 28 years of traffic enforcement, that's good enough for me.

does this mean that if i have a road test after June 27th, I am safe to drive at 50km/h through a school zone (even with the 30km/h sign) since school is not in session?

Unless it says Summer School, yes.

Hey, I already said twice above, why not slow down anyway to be safe? Just pointing out what you've got there doesn't say, "Hey, this is law", it just says, "this is what your ICBC examiners will be looking for, so make sure your students drive accordingly". It makes sense given that IN THEORY the strike could be over tomorrow (as if), classes would be back in session (technically), and school zones would DEFINITELY be in effect.

Zulu, I've got that letter too.

The Motor Vehicle Act only specifies that school zones are in effect during REGULAR SCHOOL DAYS. The MVA does NOT define a regular school day. ICBC does not have the authority to define a regular school day either.

According to the School Act of BC, each DISTRICT defines a regular school day based on their district calendar.

The act of a teacher strike does NOT alter the status of a regular school day. It is still a school day by definition even in there is a strike.

(Soundy is right in that the strike may be over and kids back in school and you may not even know it..)

Therefore, ICBC is correct in warning that school zones are still in effect during a strike.

There is precedent for my argument here:
CanLII - 2010 BCPC 56 (CanLII)

IMHO the bigger problem is the amount of school zone signs are obscured by trees and branches.. and in many cases the neon yellow actually blends in with some trees. I always teach my students to look for the playgrounds and big grass fields as a trigger to look for playground/school signs.. but the average driver these days is OBLIVIOUS to most hazards and needs BIG OBVIOUS SIGNS.

so what you guys are really curious about it whether you can travel 60+ or have to keep at a low 40+... because we all know most of you don't go 30 when you are supposed to anyways.

You can't do those speeds in Duncan even if you wanted to ... You're lucky to hit the speed limit during the day this time of the year ...

I used to work that area and people complained about the traffic problems on the Hwy. They asked why the Hwy didn't bypass the city, and so did I, until a local resident pointed out that the 4 lane running from Silver Bridge to north of Timmies...IS the bypass. If you build it, they will come & jam it.
