Shop Closure Over Holidays

My boss has decided to close the shop after a half day on the 24th through until we come back on Jan. 2nd. Aside from the stat holidays, weekend days off, etc, we won't be paid for the other days. We do have the option of using vacation pay to cover those days but I only started 3 months ago so I don't have enough nor would I want to use the few I have. Money is tight, with a baby due next month, so I can't afford to take time off. I've had other jobs where were paid over a work break like this so I assumed that was the norm. Do I have any options here or am I shit outta luck?

Mr.HappySilp 12-11-2014 02:20 PM

Out of luck maybe? Or try getting a temp job maybe at like a mall or something?

melloman 12-11-2014 02:27 PM

Kind of SOL.

My office does not CLOSE per-say, they just don't make it mandatory to be in. We let all our clients know staff is limited and we will not accept any deadlines given inbetween the 24th and the 1st.

Kind of sucks that your job is just closing doors and not giving you money.

murd0c 12-11-2014 02:32 PM

That honestly is a pretty dirty move, most companys that do that pay there employee's since its the season but to be honest sounds like you are SOL in your situation.

Sell some drugs

Hondaracer 12-11-2014 02:50 PM

GF's company does the same thing, forced unpaid time off essentially

GF looked up all she could find in the labour relations act etc and the wording is pretty vague but basically they are within their right to do so

qft.
unfortunately it's up to the shop's discretion if they'll pay you for the closure or not and legally they do not have to. :(

Great68 12-11-2014 02:54 PM

SOL.

Employers have the right to set their business days/hours.

Wife's work does this. It's fine for us just extra vacation days, fortunately for us the time off is more valuable than the income.

fsy82 12-11-2014 03:01 PM

Let your boss know about your financial situation and maybe he can give you an advance. Or he may get into the xmas spirit and give a bonus to help you out. Before posting on here you should talk to management.

vitaminG 12-11-2014 03:26 PM

this is not uncommon. my last work did it, but our xmas bonus mostly made up for it.

im sure theres some seasonal help wanted ads in craigslist. or hit up labor ready if your that hurt for cash.

Hondaracer 12-11-2014 05:24 PM

I'd take all the unpaid time off theyd give me if I had the choice lol

murd0c 12-11-2014 05:30 PM

Thinking about this more... You are only not getting paid for 3 days of work, they have to pay your xmas, boxing day and Jan1st so whats the real issue? I don't know your money situation but everyone should have back up for at least a month since you never know what could happen.

a lot of construction companys pay out holiday pay per check and don't let you bank it

GLOW 12-11-2014 06:53 PM

i didn't read up on the labour site but enough legit companies do that so i'd say it's kosher. the practice is either unpaid or they make you use your vacation.

maybe see if you can sign up at a walk in temp agency during that time and do some short term random job that'll give you a paycheck if $ is tight.

B!tch 12-11-2014 07:26 PM

Your employer can set work days and hours. Shop closed, you don't work and paid hourly you are SOL. Too bad they didn't tell you this when you were hired.

labour relations act? - you are covered by BC Employment Standards Act.
unions have collective agreements but they can't be less than BCESA (as if)
if you work for one the professions listed in section 31 below you have your own act Employment Standards Regulation

December 26 aka Boxing Day in BC is not a Stat Government of B.C., Ministry of Labour, Employment Standards Branch, Statutory Holidays Factsheet

."a lot of construction companys pay out holiday pay per check and don't let you bank it" You may be paid out your vacation pay each cheque but guess what? YOU can bank it. Move it your savings account each pay, tuck it under your pillow but to are free to do what you want with your money.

"Let your boss know about your financial situation and maybe he can give you an advance." - Your boss is not your financial planner, he is your employer. Go ask your bank or family for a loan (DO NOT GO TO A PAYDAY LOAN COMPANY) Piece of advise, by asking your boss for a "loan" you are saying, 'I don't have my shit together, can't make good decisions and I am going to be a problem for you'

So some of you are going to think I am being bitchy for saying that but in my long career in dealing with people asking for advances is anyone we gave an advance to never worked out. NEVER! Not once. I have put in a policy where I currently work, no advances as there were too many problems. I tell them in the interview and it makes my decision of who to hire easier.

Jmac 12-11-2014 08:25 PM

That sucks, but you're in a bad spot if 4 days without pay is this serious to your financial situation.

In the future, you should tighten your finances up, start saving some money for shit like this. Even 5% per paycheque can make a world of difference, though I'd recommend more if possible (I do 15% personally).

Since this is the Christmas season, there's a good chance you've already purchased gifts. If possible, return them and give cheaper alternatives.

Perhaps look at selling some items that are no longer important/necessary to you. Again, Christmas season. If you have something that's valuable and not readily available in stores, it's the easiest time of the year to sell it.

Advances as in vacation time/pay?

Bouncing Bettys 12-12-2014 11:45 AM

I won't be in dire straights, but it will be a tight month, especially with Christmas. Apparently this is the first time in years that they are closing down over the holidays with the decision coming this month. At least the Christmas party was at the Keg with open menu/drinks.

Pocket as many bottles of wine as you can and ziploc bag half a dozen prime ribs so you save money on food over the week!

semisrs

twitchyzero 12-18-2014 12:23 AM

that's less than a week of pay
i work for small businesses and that's pretty standard stuff
yes it would've been nice if your employer gave you a heads up perhaps last month but I don't see what the problem is...then again I don't have a baby on the way.

Fuck your pregnant wife on camera in a live show and you can make like $1,000 in an hour

nabs 12-18-2014 01:04 AM

You are SOL, the best you can do is ask them if they can cover you for the days missed then work off the extra hours later.

Every company I have ever worked for (due to the industry) have done this. You either need to use vacation hours, banked time, or not get paid.

My online biz makes huge money from all of the lonely wankers alone on Christmas, so many lonely men just jerkin' it and buying porn at like 2 AM on Christmas Eve/morning

This is 2014, if someone can fuck their wife on camera for 2014 to make a quick $1,000 during hard times, who are we to judge?

Meanwhile other people will drop that on jeans or a purse they'll wear/use once

Whatever man, I was just trying to help
