Question Regarding BC Labor, Working Without License and Scheduling*Need Help Badly*

Hi Revscene Family,

We really need your help badly

My best friend need help. I will use point form to make it short. This is
not a unionize work place.

- ministry of help found out that in a old folks home there are nurses who doesn't have license
- my friend is a registered care aid at that facility
- the facility demoted the nurses to care aid
- my friend lost her hours
- the scheduler said that the seniority of the nurses will be retain.

The point of argument here is that working with out proper license is illegal
and they should be fired. My friend should retain her hours.

Any comments or suggestion?. Where should my friend report this?

Might this Home be Lions Manor?

But bring this up with the Ministry of health that they are practicing without licenses. shit should happen fast then.

It's not that place. The ministry of health knows about this but what they(the employer) did is basically downgrade those illegal nurses and became a care aid. My friend loss her regular hours.

Is this permitted? They should fire those illegal nurses right?

Hard to say, if they already know about it they may or may not take action. or they may not until complaints start to come in, is your 'Friend' a registered nurse?

from a non unionize point of view, it is up to the facility on who they fire and who they keep. so if they decide to keep the "seniority" ranks, then yes your friend is unfortunately out of luck based on hours work.

however if the employer failed to do a check and hired "illegal nurses" the fault lies on the employer. unless the employee faked a certificate saying they were registered nurses, then the employee should be punished.

the thing is, when the facility demoted their "nurses" to care aids, it doesn't sound like the facility requires registered nurses to work there. however, if the facility needs certified care aids to work (by definition somewhere in an act or regulation), then there in itself lies a problem.

to play the devils advocate, your friend can start digging what the facility designation is and see what is required of this facility. and perhaps start complaining how there are unqualified workers working there.

but if your friend is a registered nurse, just hop onto vgh or another hospital. i am sure they will find quick work fast.

If those nurses that got downgraded are qualified to be registered care aids I can't see any issue, this is just my opinion I'm not HR in any workplace. It's no different then when things get slow and people move out of different departments and bump others with less seniority. It happens in not just non union place but also union companies.

Not a direct comparison but my wife works for a unionized company. She's been there a long time and is very high on the seniority list. The company she works for runs a large CSR Department, my wife however has moved around and right now does other things away from the CSR position. If she wants to work overtime (which is typically only offered to CSR's) she can bump most of the regular CSR's and move back into that role whenever OT is offered and she wants to even though that position isn't one she doesn't do anymore. The same thing happened to your friend but on a more permanent basis and not for OT shifts but regular ones.

She can contact Labour Relations or whoever regulates that industry but IMO as long as those people who got bumped down are qualified to do the job it's not going to go anywhere.

And start looking for another place to work while you're at it too. You shouldn't be wanting to continue to work at a place that doesn't care about you.

Also unless the "nurse" falsified her license, you shouldn't want her to be fired. 2 wrongs don't make a right.

Do you guys think BC labor will do something. Nikko was right the nurses should be fired instead of being down graded.

Should we contact bc labor or ministry of health?
