Sounds like she was hoping you'd eventually forget about the debt. Considering you so readily handed it over to her too, she probably thought it was nothing to you.
You can already tell what kind of character she has by not taking initiative to contact you about a time frame of repayment or a payment plan. It was you that had to chase her for it for over a year, with no results. And then she deliberately avoids your calls for the past 3months.

She's not attractive and she's a douchebag, that's a winning combination. I feel for the shmuck that ends up marrying this stunner.

Sue her for the $4k. if it costs you $3k to win the $4k, you still come out with $1k more than you would if you did nothing.

Its the same as what you suggested, you just sell the debt to your lawyer. There is just less broken kneecaps this way :D

nabs 01-14-2015 08:21 PM

why would it cost that much? if she signed a paper saying she owes you that much then you can just take it to small claims court, no lawyers needed.

I'm planning to purchase a place with my gf so this money will help a bit towards my down payment. Im not gonna let her run away that easily. It is stressful and I hate myself for helping her at that time. I wouldnt stress if I had More control over this situation.

I tried calling her at930pm right now but her phone is off. She texted that she will msg me when she can with no date and time. Her short answers with no specifics really pisses me off.

Anyways, she finally picked up the phone at like 2am last night and also texted back.
She says she is helping her mom with her financial problems and hence the constant delays. I know she isn't a bad person, but her family is dragging her down.

She's saying that she will do monthly or bi weekly repayments. I'm hoping atleast $500 from every one of her pay cheques, but that is just wishful thinking for now.

I'm going to call her again today to find out her pay periods and how much she can repay me each time.

I want to get her to communicate more about her current situation and to find out whether she is lying about her family problems.

Thanks for everyone's inputs so far. I really hope this chase will end soon.

Uh yes she is a bad person
whether she has family issues or not, it's not right to flat out ignore or delay her answers to the person who lent her large sum of money if she really is having family financial issue.

Tell her you have till X to pay you back because you have a place to buy. No need to play fair with her if she's not playing fair with you.

You have have a gf and you said she's not attractive then why bother with the hassle? She's wasting your time and she's giving you excuses. Get your money back and ditch asap.

PeanutButter 01-14-2015 08:45 PM

OP, I feel for you.

Yes, we all know you were thinking with your dick when you lent her the money. Expensive lesson to learn. I know what it's like for someone to owe you money.

There was this guy that didn't pay me back for a hockey league. It was roughly $300 outstanding. I knew he had money, but he kept ducking me. This went on for eight months. I didn't know where he lived, but I remember one night I drove him home from hockey to his grandparents house.

I figured I would facebook message him and tell him that i'm going to his grandma's house and i'm going to ask her for the money since I remembered where she lived. Literally, within ten minutes he messaged me on my phone and tried to call me (I didn't pick up because I was busy) and he told me he would get the money to me asap.

He said NOT to go to his grandma's house and that he would drop off the money that night. I wasn't going to go to his grandma's house because that would have been really weird, but if figured I would just say that to see if I could at least get a response from him. Turns out it worked like a charm. He game me the money and that is the last I ever saw of him.

Check her facebook and see if you can figure out any family members and try to use that as leverage. If I were out $4k, I would definitely go to her house. My incident was only a couple hundred, so that was easier to take as a loss, but $4k is significant.

I'm sure it would be relatively easy to figure out where she lives, I mean i'm sure you know mutual friends. For $4k, I wouldn't let this slide. Not one bit at all.

If you want, for $1k give me the information you have on her and i'll figure out where she lives and put a lean on her for some funds and i'll eventually get the money back for you. SRS.

iEatClams 01-14-2015 08:56 PM

OP are you rich? 4K just for a chance at pussy? that's a lot of money.

man, lending out 4K is something I wouldn't be able to do unless it's an immediate family member.

I'm not rich but she begged for help. She told me her cousin's bf had a gambling issue and he was chased by loan sharks. I was stupid enough to lend her the money bc she said she would get the money back to me in the following month when she withdraws her rsps. The money was used to pay off the loan shark.
Month after month of chasin. I only got some money back but she still owes me 4k.

Update... She picked up my call 20 mins ago saying she is at work and will get back to me shortly. Sigh....

I know she lives near sexsmith elementary school. She had a lease on a 2010 black 328i sedan. But she said the car is gone cuz she didn't have the money to pay the lease. Her dad drives a highlander. I know know a few of her friends names who works at edge water and river rock but I don't have their numbers.
I should have her email address as well.

above all, here's what you need to know:

a loan to friends/family isn't a loan, it's a gift. unless you have a signed loan agreement, in which the terms have been adhered to, to date, you're SOL.

never lend money to a friend. if anything, give it to them and hope they repay the favour.

this.

and this maxim applies to friends - you lent money to an acquaintance.

...to help her cousin's bf.. who has a gambling issue... and is chased by loan sharks...?

i say cut your losses and stop counting on that 4K for your down payment.. if down the road she decides to pay you back then take it as a bonus because when you lend out money like that, it's with the expectation you had the disposable income to spare

Hondaracer 01-14-2015 09:41 PM

to me, the thing is, 4k isnt a small amount to anyone..

4k isnt an insignificant amount. The potential of that 4k for anyone is far larger than the net negative you are experiencing by being denied your loan.

Short of anything criminal though... there really isn't anything that's going to force her to pay him; even with all these talks about written agreement, civil suits and payment garnishing.

Hell, my previous company has taken some clients to small claims court to collect on unpaid bills and just because you win, doesn't mean you'll get your due.

I'm not trying to be an asshole OP so don't take it that way, but if I were to to think of the girl's perpsective, considering that you guys aren't even tight like childhood friends to begin with, she probably thinks a friend like you is a friend worth losing, especially at the tune of 4K; which is why I surmise you're being given the perpetual run-around.

ilovebacon 01-14-2015 10:28 PM

I hope this was a lesson to be learnt. She said something about her cousin bf being chased by loan sharks lOl. I would've said fuck your cousins bf I don't even know him why should I even help and you stupid bitch shouldn't even get involved. Money is hard to come by too so you should spend it wisely. You trade time for money and time is a valuable thing and don't be so soft cause the world is a cold place where you can get stepped on. Some say to be the hammer or the nail and I suggest you should definitely be the hammer!

Money is just mana to cast bipolar spells, if you need to move your life forward sometimes you need to just get money, I understand that is how people who live "in the moment" view money as I've lived it myself and been around those type of people (porn people, drunks, drug addicted artists)

xeryusx 01-14-2015 11:01 PM

Timpo 01-15-2015 01:30 AM

ok so, how do you know she isn't going to jet to other province or country?

you don't know her personal life, if she is moving to Europe in a few weeks anyways, maybe she thinks she can get away with it?

yeah lawsuit is always expensive...what if you contact collection agency instead?

Ronin 01-15-2015 03:08 AM

Daaaammmn....$4000? And you've only known her how long?

Man, don't lend money to people that you want it back from. If I'm close enough to someone that I would lend them a huge amount of money, then we're close enough that I don't really care if they give it back. I mean, you have permission to give them shit about it endlessly but if they don't pay you back...well, what's a few dollars amongst family?

But shit, sounds like you barely knew her and she's trying to rip you off. That's a situation you could've solved with "Hey, we barely know each other so no...I won't lend you $4000."

BUT THE POWER OF BONERS

Hard lesson learned OP...Got Fucked Hard /end

Valour 01-15-2015 03:14 PM

I've taken a chick to small claims court. Best thing ever. Self serve justice. It's only $100 to register ur claim then they give u a package to seve her ass. Go to te courts and read the pamphlets there. The clerks can be helpful too.

So I got all my paperwork filed and snuck up to this chick that was dodging me. U just need to hand it to her and is considered served. If she don't take it u just drop it at their feet and is considered served.

The threat of lawsuit in most cases is enough to force payment. The next step is to get a default judgement and then u can use it to garnish her wages.

When u win the court orders her to attend so that a judge can determine her finances. She cannot lie suing the process or is considered contempt.

I suggest u file and serve her first and then negotiate. Ur leverage will be much more superior.

Best scenario... Serve her while she is at work and is on camera.

punkwax 01-15-2015 04:29 PM

Oh, put the papers in this too:

http://www.fundraisinghq.com/images/gift.jpg

She'll take it.

corollagtSr5 01-15-2015 04:41 PM

Ask her if she wants to borrow another 4k to give her a chance to win back the last 4k she lost. Then you get her to meet her at her car because you don't want to give the 4k out in public. Then you say your gonna put the 4k in her glove where you examine her insurance paper for her address. Then you you tell her now I know where you live and you jump out the car. Then you send whoever you want to send.

Jesus I hope you aren't an accountant.

-$4000 "loan"
-$3000 lawyers fees
+$1000 recovered money
= -$6000.

To me, being out $6k sounds a lot worse than being out $4k...

why the hell would you sue her for $1000 and not the full amount? i thought revscene was smart enough to understand what i was saying. use your head before you use your fingers to be a cheeky kunt mate

-$4000 Loan
-$3000 Lawyer Fees
+$4000 Money returned from Suing her
= -$3000, or alternatively speaking, $1000 of your money returned

whereas if you didnt take her to court

-$4000
+long thread on revscene
= -$4000

and that $3k example was just a really big bad case example i made up to show that even if it some how cost you 75% of the money to get the money back, you still get more back than if you did nothing

thank you for your time. :)
