| Chasing for money owed
Hi everyone,
I don't post here much but I need some advice because I failed to get my money back since October 2013.
A friend of mine owes me $4000 since Oct 2013 and I still can't get my money back. She keeps giving me excuses that CRA locked her bank account from tax issues, and family emergencies, etc.
She hasn't picked up my calls for the past 3 months but she will return short messeges telling she is busy but never gets back to me.
I only know that she works at Edgewater Casino and her cell phone number.
I know ... you're all gonna fail and flame me for lending out money to someone that I don't even know where she lives. I was silly for being nice to help at that time.
What is the best way to chase for the money back without getting into small claims court and seeking help from collections as they charge so much?
Any reasonable ideas would be much appreciated.

above all, here's what you need to know:
a loan to friends/family isn't a loan, it's a gift. unless you have a signed loan agreement, in which the terms have been adhered to, to date, you're SOL.
never lend money to a friend. if anything, give it to them and hope they repay the favour.

Unless you have signed agreement, small claim court would NOT be an option.
Even if you did, filing court claim is very expensive and if she is actually broke, there's no way you are going to get money back.
It is not a criminal offence to be broke, so it's not like they can put her in jail if she can't pay.
Although she probably is lying that she's broke...considering you don't even know where she lives, you probably have no idea about her financial status.
Consider it as an expensive lesson.
But hey, things like this, you should have an idea by now. What does your heart say? Does she actually have an intention to pay you off or do you think she is hoping that you would kinda forget it.

ok so she was an acqaintence and we became friends during the summer of 2013.
I have a written letter from her that she owes me $4000 with her signature.
she claims she is financially helping out her family issues so she can't pay me right now.
my heart says she will repay me, but it looks like its gonna take another 6 months or so.
sigh.... it is an expensive mistake.

For $4000, I would take her to small claims. I don't know why you wouldn't when you have a note with her signature saying she owes you this money.

Obviously she's just fucking you around at this point.
Anyone with any sort of honor would just go get a line of credit or somthing and pay back the debt. If she isnt a complete dead beat with a bankruptcy under her name and she has a full time job she should be able to get a 5k line of credit.
I'd just go to edge water and start asking for the money while she's at work make a scene, cause her problems, find out as much info as you can about her. Even if it meant stalking her to see where she lives etc. One night of gathering info is probably worth 4k

she has a steady job so there is income...yet no attempts to pay any of it back, not even $10 a week or nothing...don't expect to see any of it after this amount of time...
met her in the summer and lent her $4k 3 months later...i think i know what judge judy would say...but i agree with CRS, small claims...

you are either balling out of control (which i doubt if it's been a yr and you're still clinging to the idea you're gonna get your money back) or you wanted that pussy bad (sounds like you got none)
like others have said if she was serious about paying you back she would make an effort and at least give you a small amount here and there to slowly pay it off
$10-20 week is like one meal eating out
