#2 is win-win, you're helping the guy out by not getting it impounded and in the likely event he never comes to get it you have a seadoo for next summer. If he does show up give him a bill for storage fees.

Assuming you follow the roughly the same logic and process when a tenant doesn't pay rent to a landlord, then the safest thing to do is serve some kind of notice you're going to have it towed for non-payment of "rent". After a number of days, you can legally have it towed, and it probably has to be done by a bailiff, which may require some kind of court order.

Honestly, you might want to call a bailiff and explain your problem. They will inform you of the best course of action. Be prepared, this will likely cost you some money.

Then your property manager/developer will end up dealing with it and unless you and your neighbour both agree to deny that the transaction ever occurred and you don't draw any attention to yourself, you could end up being on the hook for illegally renting out a parking space. Do it right, spend a couple grand....do it the way you guys are talking about, possibly be on the hook for $20-40K.

sounds like you should get some lumber and put the trailer frame on it then pull the wheels

so when he comes to collect he can give you another $300 for the trouble and his wheels back

if you just let him come pick it up you get nothing and he got 3 months of parking for really cheap

If it gets towed, the vehicle gets impounded. All costs associated go to the owner of the vehicle. If it still does not get picked up, the impound lot is able to sell the vehicle to pay for their storage fees. How this costs money is beyond me.

I think most people are completely over reading this. I posted it as a joke because I think the situation is pretty funny actually. I really don't care about the money, I really could care less the spot was used while I was gone. There was no binding contract made. In fact there was no contract at all. This is a situation where someone has some shit on my property and I'm going to move it unless the guy who owns the shit moves it first.

yea, considering nothing was ever agreed upon in writing i dont think the sea doo guy would have any recourse whatsoever

Just talk to the building manager and have him call the tow company that deals with the building. Problem solved.

The issue with talking to the building manager is you aren't supposed to rent out your spot to someone outside the building. Despite the fact there was no formal agreement I don't want to go down that road. I don't see the building as a problem at all. The local city sidewalk will work just fine.

Lol thanks for the offer but I don't have the balls to sell it. That's when I start getting into legal issues lol.

It is brand new though, but looks to be a fairly basic unit. My neighbour in the other hand has a supercharged sea do. They thing is nuts.... Until it gets to it's top speed in like 3 seconds and physics just takes over.

He does not have to tell him about the agreement and it was only for one month. We have towed tenants and customers cars in the past.

Oh shit I didn't know people did that type of work to Seadoo's. I know that they do to snowmobiles, I have a couple friends with Turbo Sleds. But a seadoo with FI must be nuts, cause Seadoo's are all throttle, you're still smiling as you hit the rocks...

Cash was exchanged for property rights. That is the agreement right there. It doesn't have to be in writing. He illegally gave the guy rights to use the property the moment he received the cash and gave him the spot to park in.

In fact I never received the cash, nor did I give access to the garage. One could say I let my neighbour "rent" the spot. He is a tenant of the building and completely in my right. Not once did I make contact with his "friend."
