How do we know that when he was only arrested a day or two ago? How much time has the Police or Crown had to gather evidence or determine motive? Has an autopsy even been done yet?
At the end of the day I don't think I really care which of the two he is charged with as long as he gets the maximum sentence. But it seems to me like Crown is just afraid of doing a little work here and getting their hands dirty. It's not a far stretch that with his knife in his hand and the attack he made without provocation, that 1st degree murder is more than likely what occurred than 2nd degree. | I'm not sure exactly how it works, but can't Crown lay a 2nd degree for now and opt to change to first degree if they found further evidence?
I get it is easy for us to say that it was planned and deliberate, but the police and Crown would have to back track and find hard, factual evidence of the planning and deliberate before he committed the act. If the evidence found is weak, the first degree charge will get thrown out regardless. Look at the Pickton case for example, all that evidence and investigation and still, many of his first degrees got rejected for 2nds. |
