| Need help removing troublesome tenant
I am posting on behalf of someone I know.
So a family rents out downstairs suite to a man, they start to hear loud banging, shuffling and violent sounds as if there was someone else in there fighting and thrown against the walls. From time to time, there would be additional "womans" yelling "please stop, no!" and other times just broken sentences that do not make sense.
RCMP have been called to the residence a few times at different hours throughout the night (could be 11pm-5am) they also hear the loud noises and think the man is holding someone hostage so they bang on the doors until he opens up, and they search the entire suite to find noone inside. They also parked outside a few times to watch and see if the man would leave with someone else. All they said was that they must get rid of his crazy ass asap.
One time the man comes upstairs and makes a comment to the mother saying "you are beautiful, and your husband is old", he also asks the children what the mothers name is.
two of the family's car tires have been slashed about a week ago, and the man set up his own camera to see if anyone enters his suite.
An eviction letter has been given to him and he has until MAY 1st. He is now finding different excuses saying they entered his suite and touched his belongings and say he will sue to stay longer. They are not sure if hes bluffing, because he sent a text message saying hes reporting a file with the residential tenancy branch and also a text saying he is protected by mental health and they cannot win.
It seems like this nutcase is a dangerous schizo and that hes done this in the past because he was fully prepared against them as soon as they found out and heard all the noises downstairs. There is also a second tenant in his own seperate suite that has made no complaint and does not talk to the man.
Is there anyway to get him out? day to day they cannot sleep because of having to call the cops due to the aggressiveness of his actions getting louder.

your friends should do their own research on the tenancy agreement and know the proper procedure for removing a tenant or the potential "loop holes" they could have use to get rid of him. Instead now it sounds like the guy probably does have a case with the tenancy board and will more than likely see some payment from your friends if they simply evicted him or gave him proper notification that a "family" member would be using the space etc. They probably could have came to an aimable resolution, now its probably just going to turn into trouble.
Lots of questions like this recently and imo it's all on the home owner that got themselves into this situation, they didnt do their homework.
This past year was the second time i've rented a property out, albeit this second time was a basement suite which is far different than a condo etc. i never have to hear or see about.
Since i hadnt done it for quite some time i spent literally 25-30 hours reading through the tenancy act, writing additional addendums into my contract, and screening the fuck out of my applicants. The end result have been amazing tenants who i'm actually going to be lowering their rent if they want to renew for another year.
Somone saying "do this! or do that!" on some forum has no weight.. your friend should have know their plan of action or been a better landlord from day 1, now its biting them.

It's possible to get him out. But you have to apply to the RTB first for an order. and they have to approve it. You can't just give him an eviction notice on your own under this situation. Quote:

Significantly interfered with or unreasonably disturbed another resident or the landlord
Seriously endangered the safety, rights or interests of the landlord or another resident

Good luck getting him out. I had a bad tenant, various police incidents, damage to my property and gave all the notices but they still didn't get out. So basically I had to find a realtor, do a fake listing and basically tell the tenants I'm selling my place so you need to gtfo. It worked but I learned my lesson after that.
Do your homework because notices and the RTB doesn't give a shit about landlords, they will always side with tenants no matter how bad they are and most tenants know this so they play the system and will live rent free for months before they leave.

Just because a house is for sale it doesn't give freedom to evict tenants. There has to be concrete proof that the buyer is using it for their own personal use, extensive renovations are going to occur, or the place is being torn down.

Just say you have relatives moving in or you plan to live in that place. Once he is out don't rent it out again for a few months (half a year). That way he can't back at you.
Is the easiest way to get someone out. Even if he is protected coz he have mental health he still have to leave if your intentions is to use the space for personal use (IE letting relatives live there or the landlord want to live there).

Something is bound to work or you're stuck with bad tenants until they leave on their own or you go through the process and get a court order to remove them but even that's not guaranteed.

Give him his 30 day notice for cause. If he does not move out file for arbitration. Have done this many times. It could take up to 3 months to get a date depending how busy they are. Arbitration will be done over the phone. About 50 percent of the time the tenant will not call in and you win. Other times I have submitted enough evidence for them to lose.

Is that even legal? What do landlords generally do when they are selling, and the new buyer makes this request?

I had to read through this shit multiple times with my long-ago ex who was having issues with her tenants.
In short, as a landlord you have to document everything and anything. I'll say that you can be friendly with your tenants but always at arms-length. Everything has to be black and white in order to cover your own ass.
