On the one hand I'm not surprised it was overlooked, given they were going bankrupt. Given that they were around for quite a while I'm guessing some of the lapses in security started back in the day when it wasn't seen as such a risk, and then simply carried through out of habit.

Is selling the items Illegal? The warehouse act states that if you rent out a space to someone and they don't pay for a certain amount of time the property becomes yours. You can do whatever you want with it. Selling servers with Data on them or not it's just a server your selling?

I'm speculating here, but I don't think it works that way with personal information. If you have collected that information (in this case by buying the server with data on it) I think you have a duty to protect and not distribute that information as described in the PIPEDA

I dunno. Data is just data. It's what someone chooses to DO with that data that the potential "crimes" and law may come into effect. Probably why the RCMP is hesitant to act. There is no crime "yet"

Except that personal information isn't "just data". It can be an offence just to improperly disclose any of it regardless of what is actually done with it.

You have no clue. Some information like personal info, credit card info cannot be legally distributed without consent because they are private information and the consumer hasn't give you consent to distribute it. Distribution of private info is the crime here. The data doesn't belong to the hardware buyer. He only have rights to the hardware. NCIX itself also doesn't have the rights to distribute said data without your consent.

Buddy Jeff in this case is clueless. It's no different than the scenario where he hacks into a network and obtain private information. That is enough of a crime, let alone selling it.

The website guy is clueless, too. He writes clearly on the website that he has clear intention to access private information.

NCIX's negligence doesn't absolve these clowns of their wrongdoings.

yeah but these pictures were in the owner/co-founder's personal home computer though...which doesn't make sense at all.

It's not like his house was raided in the middle of the night and he had no time or something.
