Comment from an alleged neighbor (bottom of article) seems to confirm that guy is a fucking douche:
Quote:

Everyone has the right to quiet enjoyment of their residence. I live across the hall from Mr Astifan and have many times been disturbed by him and his son running and playing in the hallway. I can only imagine the noise level for the couple that live below him. I spoke to the building manager and was told Mr Astifan was made aware of the noise issues several times verbally in the hopes it would not continue. That did not happen. He was offered alternate suites in the building as well as other properties in the owner’s portfolio. He refused. He lives in a beautiful unit with an open loft and was suggested that this bright spacious open loft area would be a better play area for his son. He refused that suggestion as well. After many months of discussion, a first written breach notice was issued. In many buildings you only receive one written warning before eviction notices are given. Mr Astifan was given a second notice a few weeks later. His response was, he pays $2865 a month and his son can do whatever he wants. He was warned that a third notice would result in an eviction notice. He responded by saying, go ahead and give me another one then I’ll get 2 months free rent. Im not sure what he meant by that. Mr Astifan is trying to paint himself as a victim and that is just not the case here. I am pleased with the efforts of our owners in handling the situation and with the RTB for their process.

So it wouldn’t be uncommon to run a load daily, but all night is a little excessive

Just throwing it out that that as a parent often there are things I'm doing at the end of the night i.e. washing dishes and sometimes even laundry. Depending on the washing habits of the person it isn't out of the question to say the laundry is going all night or at least feels like it. If someone uses a regular wash mode and opts for extra rinse and spin that load could take like 2hrs and drying on top after could be another hr. But meh who knows.

It seems like this is one of those guys who wants to use all the rules in his favor to push his issue but when those same rules are applied towards him he doesn't think they should apply or are relevant.

I wouldn't rent to this guy, he'd be a nightmare.

Mr.HappySilp 01-23-2019 11:17 AM

Dude is an asshole. When I live with my parents in their house and they rented the basement suite to a couple with 3 kids (2, 4 and 7 years old). Never we had any noise issue. Sure you might hear them once awhile but it wasn't crazy. In fact I think we make more noise than they do when we have guest over. Is about how you teach your kids and this guy doesn't seem to care.

This guy is lucky he doesn't live in my building coz if he was he would have gotten the boot ages ago. People are anal about noise in my building that there were 6 or 7(can't remember) noise complain during New Year Eve. My god is New year eve of course people is going to have guest over and party. Just relax.

Lol plays soccer in the hallways and lobby. Has a power wheels in the living room and is seeking sympathy!?!?

Mr.Money 01-23-2019 12:07 PM

no wonder why his now ex-wife left, does seem like the petty asshole type who once you get to know you cannot stand, poor sack of shit does this to grab media attention and doesn't know to move on.

i wonder if he would be publicly shamed now the information is out they tried siding with him but he gave such an asshole response back.

GS8 01-23-2019 12:25 PM

He's getting earfuls from other people on his FB page :haha:

It's always a good day when a douchebag gets what's coming to him. I feel sorry for the son. His father is not doing him a favour. Most likely, the kid is going to grow up to be just like his father.

I can see why he's a single father. What woman in her right mind would put up with such an asswipe. Sad part is, the mother had a child with this loser.

his FB page. Looks like is pretty divided.

Funny how some people suggest he goes to the court and even started a funding page for him to get a lawyer.

Ludepower 01-23-2019 05:32 PM

It was mentioned earlier. For the Residential Tenacy board to kick the tenant...he must of really fucked up bad.

I had to deal with a problem tenant with mental issues who was purposely slow trickle flooding the suite, banging weights on the ground and police reports confirming it

The tenant won the hearing even with all the evidence and written statements from fellow tenants. They have so many rights and chances that they usually win.

The happy ending to my nightmare was me and other tenants forcibly removing him and his belongings on the street and not giving a fuck if the cops came.

I am super curious what would make someone do that though? Any guesses?

Had twins and are using cloth diapers? Even though their clothes are tiny the amount of laundry my kid generates is insane, if you did cloth diapers as well and then doubled that you'd have a crazy amount of stuff to wash and if you have smaller/slower machines you'd be pretty much constantly running them.

That or they've got one of those cloth diaper pick up/drop off services and are running it all out of their apartment.

Was trying to figure that out myself and I could be totally wrong here but it seemed like some MLM where basically the business model is you get people who have businesses to pay you to speak to them about how they can improve their business.

The rub is their only qualification is being able to sucker people in to pay them for business advice even though they have no real credentials. It's almost like that old saying, "those who can't do teach" but they took it to the nth degree.

Expresso 01-24-2019 08:24 AM

Read some of the RTB documentation. This was one of the complaints lol.

This issue was first brought up on January 30th, 2018 in which I used to take Marcus running in the hallways at night to burn off his energy before bed. After receiving a letter from Serge, I apologized and I stopped taking him running in the hallways

Wouldn't your tenants able to sue you for doing that? You could get yourself in a lot of troubles for doing that...... Now I wonder what would happen if the other tenants who also live there place a restarining order against the crazy tenant. Would he be kick out automically then since he can't come close to the other tenants with a retarning order.

freakshow 01-24-2019 08:58 AM

If he ran through the hallways a few times and played in the lobby, then stopped after the warnings, he wouldn't have been evicted.

Something is missing from this article... like the other 3 million times of him being an asshole neighbour

Agreed, buddy can say what he wants but it's pretty clear he felt it's his place he has a lease and they can't kick him out for a noisy kid so fuck em go ahead kid do whatever you want the tenant laws will protect me. He didn't stop to consider that those same tenant laws apply to the people around him and their enjoyment of their space.

IMO the nail in his coffin was that the landlord tried to compromise with him by offering different units, if this didn't happen he probably would have won. Since they tried everything they could do to reasonably solve the problem for everyone involved they arbitrator had no choice but to side against him.

m4k4v4li 01-24-2019 10:30 AM

hopefully he doesn't instill these entitled values into his offspring that one's personal needs should supersede that of the common good

just like how he value's his own loft view over the freedom of his child to express himself and have fun, some people shouldn't procreate

imagine being stuck on an island with this douchebag who refuses to compromise

guy would get immediately banished and tied to a wooden floaty

bye bye

Eff-1 01-24-2019 10:55 AM

Here is his letter to the RTB asking they overturn the arbitrator's decision:

Great68 01-24-2019 01:54 PM

I'm guessing when this guy had his meeting with the arbitrator he was one of those who would speak out of turn, yell at the landlord, interrupt the arbitrator etc. All perfect ways to get a ruling against you pretty damn quick.
