Legality of selling car with old tires

Quick question for the guru's. I've read through the MVA but cannot find a definitive answer. Looking at purchasing a car that has tires on it from 05/06, at least one of the tires is cracked and showing signs of dry rot on the sidewall and between the tread. Is it legal for a dealer to sell a vehicle with tires in that condition? Is there an age law on tires?

Dealers sell cars with illegal parts on them all the time, from everything I've seen there's nothing preventing them from doing this.

You can legally buy a car with NO tires.

Yep, nothing keeping them from selling you an unsafe vehicle. Once you license it, however, you're responsible for ensuring it's safe.

There are no age laws on tires. Just condition and recommendations.

Have the dealer replace the tires as part of the purchase.

I'd use that as a bargaining chip and get the price lower by $6-800 because you will need a new set of tires. I would not have dealer replace them cuz they choose cheapest crappiest brands like Triangle or Cooper. Use that $$ to buy a set from Discount or TireRack. Done.

Easy, then do the math accordingly. Negotiate $2400 down.

There's no such thing as a 'regular tire' for a Viper. They're not something you cheap out on with these cars. Driving it on its current tires is flat out dangerous.

The car in question is rough and in need of serious TLC from a passionate owner (me). I'm trying to rescue it from it's current location before it rots beyond the point where it makes fiscal sense to bring it back to life. Unfortunately the current owner is woefully ignorant on its value in its current state so negotiating is difficult.

Negative. This one does have some serious history but its rarity is worth restoring.

This is exactly why I rather negotiate the price down and get tires that I want. If they replace with brand new set of Triangle or Cooper ... would you buy it at list price?

There are limited options in the sizes required and all are good tires. The question was posed as I was hoping to use it as leverage against the dealer in negotiating the sale price. Doesn't really matter though because the car needs so much work it's just another item to add to the list that the dealer hasn't taken care of. Their only justification for their price is 'bEcAuSe vIpEr' and that doesn't fly with me. They can either sell me the car at a fair price given the 8-10k I'll have to invest to revive it, or it'll sit for another winter with no service or care given and be trash status by spring.

I don't know about a law per se, but I purchased a used Toyota from a Toyota dealership. When I went to pick it up, it was all washed, and I went up to it and noticed a slight chunk missing from a tire sidewall, with the cords slightly visible. I brought it up to the salesman and he brushed it off as, "ahhhh, don't worry about it."

I already felt I was getting a good deal and I had my bank draft good to go so I thought, screw it. But before I left he said, "can you come back tomorrow? We'll replace the tire free of charge."

I think after I brought up something that could potentially be unsafe they didn't want the liability.

My apologies if I am taking this thread on a tangent, but since my situation invloves the selling of a vehicle and liability, it's not straying too far.

I am looking to buy a vehicle in a private sale on craigslist. The vehicle is not insured and the owner suggested I could throw my plates on it for a test drive. I'm not keen on doing that - besides the insurance and plates I would be swapping over after a purchase expired 3 days ago. I intend to ask him if he will put temp insurance on. In case he refuses, should I offer to pay to cover his day insurance whether I buy the vehicle or not? Or should I see it as a red flag and walk away? What do most law abiding due diligent people do when looking at uninsured vehicles?

If he wants to sell the car, then he should be buying a day permit.

If you want the car bad enough, then offer to pay for the permit. Same goes with getting the car inspected. it's for your protection.

I'd take a look at it to start with and if it looks good parked then pay for the day insurance. Like paying the $75 for a history check I'd consider that a fairly cheap part of buying a car.

If he's fine with it being driven around with zero insurance coverage I'm assuming he's not overly worried about the car so that might be something to keep in mind when negotiating?

You have 48 hours grace period when you BUY a car to swap your plates on it and drive it before you have to register it with the plates. You can't just toss them on any car and be covered while you are driving it.
