Don't try to kick out a tenant for the next few months. It's only going to end bad for you. Wait till cov-19 over Is the smoke smell affecting your in-laws?

My father in law in very sensitive to basically everything (he gets every side effect listed on the bottle, even Tylenol). Not to mention damage to the place with brand new carpet. He has been more or less bedridden for the last two years with multiple fractures to the spine after cancer treatment. This stress isn’t good for him either.

This is an excerpt from the government website highlighting some of the changes, this caught my eye.


“ Halting evictions by ensuring a landlord may not issue a new notice to end tenancy for any reason. However, in exceptional cases where it may be needed to protect health and safety or to prevent undue damage to the property, landlords will be able to apply to the Residential Tenancy Branch for a hearing”

You have to be careful not to cause more issues. A new camera installed monitoring their activity is infringing on their right to quiet enjoyment.

Lastly, you really should chose one route or another now before you move forwards with anything else. Having these issues sitting here online and actively looking for evidence on the smoking gives them a way to counter your good-faith argument for wanting to move in (ulterior motive).

Yes. I understand that. Moving in is my #1, but that is pending on our place selling in a very turbulent time. If in fact we are unable to move in during this period due to tenancy act changes, It would actually change my decision to sell which is complete BS in my opinion. We can’t even move into the main house as both of us are essential services. We both work high risk jobs of getting this virus. We literally speak to the in-laws through a cracked back entrance door as my elderly father in-law is very high risk of this whole crisis (previous chemo treatment).

I know what you are saying about the camera, but having a camera in the backyard which is the main access to the main house is hard to argue.

You make pretty valid reasons about picking one way or the other. In reality, we would like to move in. The sooner that is available the better. With more frequent smoking it really irritates me someone can be so disrespectful to such kind and giving people.
