: Please help a fellow Vancouverite identify the guy who assaulted him

Saying "You wanna go" or anything like that does not make a mutually agreeable fight. Trust me I know. The judge even said so. 2 people shoving first and THEN fighting yes that's mutually agreeable in the eyes of the law but nothing verbal can be construed as evidence. Had he fought back or been able to fight back it would have been mutually agreeable. I hit him once. In doing so I broke his jaw in 3 places and fractured his orbital socket. He never got a chance to fight back and that is considered Assault Causing Bodily Harm.

So basically if ur a one shot knockout artist, ur gonna get charged all the time unless u take the chance and let him hit u first. Cause i also heard that if u get into a fight and the guy doenst lay a hand on u during the fight its considered Assault Causing bodily harm.

I was in a similar situation in my youthful high-school days, being naive and stupid. This bigger guy was picking on my friend in the halls of school and I stepped in and punched him in the face on the cheek breaking his nose and lower eye with just one punch. The guy charged me with assault causing bodily harm, but I was able to get out of everything due to the fact that although I did punch him once, I did not continue to hit him even when I had the opportunity to do so, thus it would not be considered bodily harm. I was also dropped of charges because it was proven by all the witnesses that the bigger guy was about to punch my friend and I had only stepped in to help my friend who was about to get hit. Again, had full opportunity to continue to hit him but walked away after the first hit.

Also helped that the plaintiff lied in his testimony.

^^^ Exactly.A judge takes into consideration your past and your future. RFlush EVEN if you had been found guilty you would likely have gotten a diversion as a first offense and no criminal record. If he was 'ABOUT' to hit your friend ie. in the process of bullying it would be justified. If he had just been standing there and talking shit that would NOT be justified. Totally different circumstances. You got off because you were protecting someone else from harm.

Of course you know "this guy". And I'm sure "this guy" told you a very pretty story about what happened. It's way easier to believe your own brother than some random guy who will be pressing assault charges against him.

yeah thats what the judges say, but its pretty much up to your lawyer to "play" with the law to get you off.

back in my youthful and naive days, i got charges way more serious than assault causing bodily harm, and I got off free even with witness to my activities. Let's just say these activities could result in 10-20 year sentences.

That is the truth, you cannot consent and make a contract for something illegal. As such the, "you want to go" is no valid defense for fighting.

The guy will get a slap on the wrist. I have no faith in the law these days. Look what happened in the case with the 3 white guys beating up the black guy in Courtney.

A guy I know was walking with his girl in a park in N.Van. A bunch of young native kids started heckling her. he stood up for her. They swarmed him and ended up killing him smashing his head in with a rock.

All the kids involved got a slap on the wrist. While this young man is gone forever.

Fuck the cops, bring back street justice.

Another time a friend of mines roommate, caught some punks breaking into my friends GFs car. he hogtied them in the garage and called us up when we where at a party. My buddy went home and beat the living piss out of the guys.
The cops came and patted him on the back! needless to say when one of the guys was in the hospital he said he would never break into another car again.

I find this tale very hard to believe,the cops came and patted him on the back? Ya maybe in yours and his dreamland.This person you mentioned(the one that got patted on the back by the cops),committed some pretty serious crimes,like assualt,kidnapping and unlawful confinement.And to top it off,he was dumb enough to call the cops and show them what they did to the person and not get arrested.

I call complete bullshit on this story.

That's just it,you "heard" from someone,unless there is actual proof of cops doing this,it's just all hearsay or bullshit(not calling you a bullshitter btw).

If there are indeed cops out there that don't do their job properly,those types of corrupt cops are also more than likely to be the ones that will also beat the shit out of people too.

I forcefully held someone who I caught stealing my gf's car and the police told him he was lucky I didn't do worse than I did.

I choked him with the seat belt, dragged him out the window and roughed him up while I waited for police to show. I got a thank you and job well done.

i find your last story hard to believe too. how does 1 guy manage to hogtie multiple kids? did he tell them to stand in a line from shortest to tallest while he tied them up 1 by 1?
i also highly doubt the cops would pat your buddy on the back and say good job after he tied up some kids and beat the shit outta them..maybe if this was the 50's in the south and the kids were black i'd believe your story

if any of you were cops, and you were called into a berak and enter... and you came to find that the people who had their house broken into shit kicked the intruders, would you arrest the home owners? i know i wouldn't .. it is called trespassing.. there must be a law somewhere that states, if you are intruding/break and entering etc... the home owner, out of self defense, can fuck you up 80s style until you GTFO!

i was talking to a guy at my gym today, he told me that a bouncer had sucker punched him in the face when he was drunk at foggy dew a few weeks ago. the guy who got punched ended up with a plate in his face and a lot of scars on his face/head. i told him to sue foggy dew since the bouncers should not be running around the place punching guys in the face, even if they are drunk/belligerent... gotta love the tough guy bouncers who only pick on the guys half their size and who are too drunk to defend themselves/fight back

guess what the cops did about the whole thing? absolutely nothing.

if he blanked out and somebody called the ambulance for him, there's a paper trail right there of a witness. there should be tonnes of witnesses/camera footage evidence. and if not, he should at least try and see if he can get the guy to admit it in person (while secretly recording the confession as evidence). if all else fails, the guy should just take justice into his own hands. face or a face makes the whole world.. faceless?

Sorry to hear about your buddy man. I always thought the bouncers there were pretty proffesional is your story is the first time i've ever heard of them hitting someone or doing something like that. That's unfortunate. The Spike.. Now that's a different story.

That guy should be talking to a lawyer and filing a lawsuit. The owners of Foggy Dew will have no idea what he has for evidence or witnesses. I guarantee if you have a lawyer contact Foggy Dew about the incident you're going to get their attention real quick. There have been a few high profile cases like this and they cost the bar a lot

The bouncers are not employed directly by Foggy, so he'd have to sue the security company instead.

doesn't matter if they had good reason to punch him or not... they are bouncers, who are supposed to simply remove people who are too drunk from the bar.
and yes, the bouncers there work for Genesis security, so he should be suing both the bar and the security company.
