It's illegal to only hire or want to hire an individual based on gender.

Except that BY LAW it is illegal to hire based on gender. So your point is null. What BlueG2 stated was a loophole and a way for businesses to hire based on gender without getting into trouble. All they have to say is that the applicant did not meet qualifications.
