LEGAL issue help plz

So long story short

over the weekend had a fight with the gf, she tried to get away from the conversation so i grabbed her shoulder trying to make her stay where she is. Fight continues (only verbal) and she called the cops
cops ask her for injury, her shoulder was a little red, due to her moving towards (left) i tried to make her stay by providing force to the right.

Cops came couple minutes later and arrested me.

Now i have a court date in the end of the june.


Gf was mad so exaggerate things.

I was in police station getting finger print and all that jazz. The cops themselve said it is NOT that serious. However the file says (ASSAULT) which scares me.


Do i need a lawyer?

I spoke to one lawyer and he said i must get one. Costs $8-10g since he said he is very good at what he does.

Quesiton is if gf says it was nothing, and doesnt wonna press charge. Will i be okay?

Never hit a girl nor have any sort of criminal record in the past.

Please help, super stressed and paranoid right now.

Anyone been thru similar situation?

well, during your court case the judge will ask " did he in anyway physically hurt you? " he/she will clarify and add " other then grabbing your shoulder" . she will say no and everything should be good, she doesnt press charges and case will be dropped. happens quite often to tell you the truth. dont stress out too much.

unfortunately, things like these have to be filed and they usually go under assualt. sorry pal.

they should provide you with a lawyer if you cant afford one. but you should be fine. just tell the story the way it is.

Actually, a girl friend of mine recently went through something similar, except the guy was actually beating her. She ended up calling the cops on him, they saw all the finger marks, bruises etc...


She was going to drop the charges cause she didn't want to ruin his life.

Few weeks later, she got a call from his parole officer saying that in this situation, it's not up to her whether she wants to press charges or not. In domestic situations, it's the court that's pressing charges because the women often do end up getting soft and dropping charges.

Might want to talk to a lawyer.

ya thats what im afraid of, she doesnt wonna press charge. But it is not up to her to decide



Spend whole day yesterday searching for answer, called 3 legal aids and left msg, yet none of them answered nor replied.

Will continue to search around today

From what I know, assault is considered an infraction of the criminal code, so it won't be up to your gf as to whether charges will be pressed or not. If she was suing you in a civil manner, then it would be a different story.

shit...that sounds like i have a high chance getting fucked if i dont get a lawyer sigh


I called legal aid, said i wasnt eligible for such service since its for low income only.

End up getting referred to lawyer referral. Than i realize wtf, i dont need lawyer referrarl, i can just google one up myself.


Got an appointment tomorrow with a lawyer, first 30 minutes of advice is $30 dollar.

Dont know if its worth my time going, since lawyers are like sales by the sound of it. They want your business, not necessarily honest opinoin whether how serious my situation is.

Sigh dont know wat to do next

ask for help, ask them if they are willing to refer you to the TOP 5 lawyers, this way, it'll eliminates "referrals" to their own friends.

also ask the lawyer what fees are involved if you're deciding to really get a lawyer. Dude, you're talking about having someone CHARGE you that will go on your resume and criminal record, you do NOT want to pay 40 dollars for 30 mins of their time.

unfortunatley, police take domestic disputes pretty seriously and no matter who is right or wrong, once the male opens his big mouth he gets fucked and arrested.

when the courts see what happened , im pretty sure youll be fine. you cooperated and didnt fight back, you didnt actually hit her, etc. judge will probably look at this as a fight that got out of hand , she threated to call the cops on you, you called her bluff and both of you got pissed off even more and she rage quited and called the popo on you.

but you'll still have a record for being arrested and your prints are recoreded. but the charges will be pardoned. ( if any )

just dont go ape shit on court date and let it be another judge judy episode

ex : " i didnt touch the h*e , but i tell ya what judge , that b***h owes me money "

THIS
whether the "victim" decides to press charges or not is against the point, the state will press charges separately...BUT under these circumstances they may drop the charges because they are not as serious, or order you some type of counseling (even though you grabbing her shoulder is still considered assault)

Silly girls... The sad thing is that your gf (well I damn hope your present ex-gf) isn't all that rare. I've dated a girl once and she pulled the same stunt except there wasn't anything physical. Though, there were always threats and such.

Once you see those actions, either set them straight or gtfo of that relationship because in the end, you're gonna be the one who has to suffer. There's far too many girls who think they're princesses but in reality they're not all that special.

nonono i totally understand where you are coming from.

I definitely do not wonna fuck over my life by saving $40 dollars. Thats not wat i meant, im just looking for the correct guidance.

we really aint enemies, i know im at fault, and so is she.

I aint no saint, and she definitely gone overboard. However this is the first time it happened, am i mad? hell ya. BUt she is definitely more than sorry at this stage, she knows the consequences now and it definitely got blown out of porportion.

We are still good, and she is very sorry for what happened. Again as soon as she saw me getting arrested, instantly she tried to pleade to the police to let me go. Obviously he said "NO" lol


Im just still fairly pissed off at her by causing me soooo much trouble. so im undecided yet whether i will date her after this mess or not, besides im seriously WAY TOO PISSED OFF RIGHT NOW so i cant think. But judging by this thread, everyone is against it. LOL
