^ not sure if it makes a difference, but Toyota wasn't the one who made the engine, it was Yamaha I believe. Perhaps Lotus bought the engine from Yamaha instead of Toyota?

so then BYD pretty much has it made. since it's a toyota design that has already been sold in the US, then it should pass crash testing, etc. if they can prove that the driveline is reliable and won't burst into flames and there is enough product support...
