| Tenant being a bitch, not throwing away garbarge
So the tenant at my house leaves a pile of trash (cardboard boxes filled with trash) at the back alley of my house thinking the city (of Vancouver) is going to pick it up and throw it away. I tell him that the city will only take the garbage left in the city garbage bins, you should find a different way to dump that garbage, it aint gonna fit in the trash can. He says okay, he'll clean it up, and 2 weeks later that pile of garbage is still fucking there! I've been complaining and complaining and tonight i finally got fed up and bitched at him and called him a retard and the dirtiest mother fucken tenant ever and now I doubt he'll ever move it. Any remedies? I can't evict him can I? He's not the actual tenant of the contract, hes actually that persons father.

Tell him the City has warned you and will fine you by X date if it isn't removed, and tell them that you will bill him for the fine and removal fee if they don't remove it by X date.

If hes not the actual tenant and didn't sign the contract then technically hes a trespasser. Contact the tenant, tell him that he either needs to clean his shit up or he (the father) is being banned from the premises.
The tenant will have a right to come back, but the father will not.
It sounds like there is a reason this guy has to have his son sign leases and contracts for him. When you called the references (Goddammit Cool Moe D I hope you called the references) I'll bet you called the son's references and not the father's.
This could be standard behavior for the man who you called a 'retard' and the 'dirtiest mother fucken tenant ever' and you should do a unit inspection.
Give them a formal notice stating that in 24 hours (Schedule a specific time) you will be performing an apartment inspection. Make sure you follow through. They have no legal right to keep you from inspecting the property if you've given the notice (or posted it in a visible place). If they don't answer when you knock, tape it half on the door frame, half on the door so the tape seal will be broken when they open the door. That way a reasonable person/landlord can assume that the notice was received and read.
Check EVERYTHING. Check for damage. Check for odd smells. Check for garbage. Check for cockroaches and bedbugs. If this guy is dirty outside of the unit, chances are hes dirty inside of the unit.
Seriously, it sounds like you have a guy who will be nothing but problems down the road and it would do you good to rid yourself of him now. Theres no shortage of renters in the lower mainland and losing him only means you can get a better one in.

I have tenants renting my place in Ottawa, I budget for their stupidity, you should too. Not every tenant is going to be perfect, some fuck-up, that's life.
My experience so far in BC is that landlords can be much more anal cause of the "damage deposit" renters have to leave. I much prefer the system in Ontario of "last month's rent" that gives more power to renters.
My roommate's last landlord tried to keep his damage deposit cause he didn't steam-clean the carpets - that's seriously anal, the carpets were vacuumed and not stained.

I think legally as a tenant you MUST steam clean the carpets when you leave a residence. I’m pretty sure that’s just standard for BC. Regardless, that’s just usually a good fhing to do, helps out the landlord and makes you look good when your looking for a nerw place and need refrences.
Being a renter, I can’t believe the horror stories I hear on here about renters. I generally get really pissed off when landlords get all crazy about checking credit and things. But when I hear crap like this it makes me feel pretty bad for you guys.
Why are all the renters fucking morons? I have rented places on my own since I was 18 (I’m damn near 30 now), my old references are always great, and I general have landlords asking me to stay when I tell them Im going to leave. Where do landlords find the loosers I always hear about here?
As a side note, anyone want to rent me a place for cheap, give me a PM, just found out my current landlord is going to sell the house I’m in. Looks like I gotta move again! HA!

and I believe the tenant has a lot more rights than landlords in BC.

Original state is relative, its a rental property, its bound to have wear and tear and age. A good landlord factors this into the rental price, that eventually the unit will need cosmetic maintenance.
It seems there's a LOT of condo renters, that are breaking even or even losing money renting, so they cannot afford to lose anymore if the place isn't "original". That's not my problem as a renter, its theirs for making a bad investment and poor financial decision.

How about you look up the BC Tenant Act then you don't have to "think".

That's a disgusting practice, and as a renter I was much happier when the landlord owed me my last month's rent and had to take me to the tenant tribunal to seek damages, cause the tenant tribunal is much more relaxed than an anal landlord.

I did call the references of the contractual tenant and it checked out ok. THe tenants rent is being paid for by the government (she's a 20something yr old native with 2 babies). I've never had a problem with her. Then a few months after she moved in, I notice this white guy in his late 30s come in, the guy looks like a junkie and starts bringing in all this trash, turns out to be her dad.

I told him what I told him a few weeks ago, the city isn't going to take your garbage thats not in the bins. So I ended up having to load all his garbage on my car and bring it to the dump myself because he doesn't have a car. A couple of months later he seems to have moved out or maybe he went to jail, I don't know. And suddenly a month ago he comes back and does the same shit.
And he smokes in the fucken house!!
So now my question is, if I were to give him an eviction notice, under what grounds should a put on the notice? How much time do i need to give him to pack up and leave? And if he's stubborn and won't leave do I call the cops?

HOWEVER, if the tenant and the landlord did an inspection and has a condition report prior to move in, and if the landlord stated clearly that the carpets were "steam cleaned" prior to move in, the tenant will have to do the same to the best as he can.
Section 23, 24 and 36 deals with condition reports and the consequences, if you are interested.

there is no think or must, but there is a "generally" on the 2nd page of this tenancy act document, right before "the tenant will be held responsible for steam cleaning or shampooing the carpets after a tenancy of one year."

99% of the time the landlord is stuck with the bills beyond the half month deposit for damages caused by fucked up tenant.

Glad someone else did your homework for you, yet as wouwou pointed out, you "generally" and "may", not "MUST". It sucks to BOLDly shout comments only to end up WRONG.
I did read my real agreements, why do you think I asked for you to find it, cause I knew its not there. There's nothing in the agreement that says I MUST steam clean carpets, so if you're a landlord and ignorantly assumed that, consider yourself well-informed now.
Now please stop giving out incorrect information and the conversation and return to friendly information, rather than ignorant misinformation.
